Missouri timeshare owners have secured a $1.3 million class action settlement resolving claims that Resort Sales Missouri Inc. and Spinnaker Resorts Inc. illegally charged closing costs.

Class Members must have purchased the timeshare from either company on or after June 1, 2014, and must not have sold it in the meantime.

Lead plaintiffs, Darrell and Kathleen Thompson, filed the class action lawsuit after allegedly being hit with Missouri timeshare closing costs. Timeshare closing costs refer to the fees required to transfer the ownership of a timeshare.

The plaintiffs claimed that Resort Sales Missouri and Spinnaker Resorts violated Missouri law when they assessed closing costs on them and other Missouri timeshare owners after June 1, 2014.

“Missourians sometimes are targeted by real estate developers and resort communities to buy vacation timeshares, an arrangement in which consumers buy vacation homes, usually in a resort area, for a specific length of time each year,” states Eric Schmitt, Missouri Attorney General on his website outlining consumer protection laws that protect buyers in the state.

The Missouri timeshare closing costs class action lawsuit alleged that timeshare owners were illegally assessed the fees.

Branson, Mo. is known for beautiful vacation spots, such as the Ozarks, as well as its 30 or more timeshare resorts. The area has been investigated by the Better Business Bureau reportedly that found the timeshare companies exhibited a pattern of “deception, pressure and traps disguised as vacations.”

According to the Missouri timeshare closing costs class action settlement, approximately 7,000 people may be Class Members eligible for a portion of the settlement award.

Each payout will depend on how much the Class Member spent on closing costs and the aggregate total of all closing costs charged by Resort Sales and Spinnaker.

Class Members will automatically be entered into the Missouri timeshare closing costs class action settlement. Class Members may object to or exclude themselves from the settlement agreement.

Those who wish to object must notify the court within 75 days of the date of their mailed notice. Class Members who wish to exclude themselves must do so within 30 days of the date of their mailed notice.

Who’s Eligible

Class Members include those who bought a Missouri timeshare from Resort Sales Missouri Inc. or Spinnaker Resorts Inc. and were charged closing costs as a part of that transaction. The sale must have been made on or after June 1, 2014. Those with closing costs currently in escrow still qualify for the settlement.

Varies depending on the closing costs paid.

None. Class Members will automatically be entered into the settlement.
