Korean Air Lines Co., Ltd. and Asiana Airlines Inc. have reached a $65 million class action lawsuit settlement resolving allegations they conspired to fix prices for air passenger travel between the U.S. and the Republic of Korea. If you bought a qualifying ticket between January 1, 2000 and August 1, 2007, you may be entitled to cash and coupons for future air passenger travel as part of the class action settlement.
The Korean Air settlement will resolve a class action lawsuit that claims the alleged conspiracy included meetings, conversations and communications in the U.S. and elsewhere between the two Defendants during which they agreed to establish artificially high prices for air passenger travel.
In cases separate from this class action lawsuit, brought by the United States Department of Justice, the Defendants pled guilty to criminal antitrust violations and agreed to pay a fine. Despite pleading guilty in the DOJ cases, Korean Air Lines and Asiana Airlines deny the allegations raised in the class action lawsuit but have agreed to a settlement to resolve the litigation.

UPDATE: On Feb. 8, 2016, a final hearing was scheduled and Judge Otero is expected to issue an order soon. Once the order is issued, the settlement funds and coupon codes will be distributed to Class Members who submitted a valid and timely Claim Form.
UPDATE 2: On Feb. 11, 2016, according to the settlement website, airline passengers who filed a claim in the Korean Air class action settlement should expect to receive a check and coupon code in April!
UPDATE 3: On April 21, 2016 the settlement website posted the following update: “We now expect that the distribution to claimants will occur in late May 2016. Additional updates will appear on the website when the date for the distribution mailing is known. UPDATE 7: On June 29, 2016, Top Class Actions viewers started receiving checks in the mail from this class action settlement worth as much as $2643.61.
Who’s Eligible
Class Members of the Korean Air settlement include anyone who purchased at least one ticket for air passenger travel on Asiana Airlines or Korean Air Lines. The purchase must have been:
- Made in the United States;
- For a flight originating in the U.S. and ending in Korean or a flight originating in Korea and ending in the U.S.; and
- Made between January 1, 2000 and August 1, 2007.
Both businesses and individuals may be Class Members.
Potential Award
Class Members that submit a valid Claim Form will receive cash and coupons from the class action settlement, which will be distributed pro rata, based on the total number of qualifying purchases and valid Claim Forms submitted.

UPDATE: KOREAN AIRLINES UPDATE THIS INFORMATION ON SEPTEMBER 11, 2015. This is an update on the distribution to claimants of the settlement fund and the coupons. The allocation to claimants is based, pro rata, on qualifying purchases of travel during the class period. Each approved claimant will receive a pro rata distribution of the cash settlement fund, along with a proportional share of coupons from Asiana and from Korean Air. The coupons will be distributed in the form of electronic codes. It has taken longer than anticipated to establish and build the electronic connections between the coupon database and the airlines’ systems. We are also building a separate website to facilitate the transfer and exchange of the coupons. We are nearing the end of the process and we appreciate your patience while the process is completed.

\09/08/2015 : Rust Consulting is in receipt of complaint #…, which relates to In re Korean Air Lines Co., Ltd. Antitrust Litigation, No. CV 07-05107, MDL No. 1891 (C.D. Cal.). Rust is engaged as the Settlement Administrator in this matter with the objective of carrying out the terms of the settlement from a neutral, administrative perspective. Rust is not a party to the settlement and does not have the authority to act outside of its terms.\
Rust has completed processing of all claims in the settlement. Distribution, however, is on hold pending submission of the plan of allocation to the court, and the court’s approval of the plan. In addition, the parties to the settlement are actively working to set up a redemption process, including a brokerage site which will allow class members to sell a portion or all of their coupon/voucher in exchange for money.
Updates will be posted to the settlement website, https://koreanairpassengercases.com/, as they become available. Rust acknowledges that the process has been quite extensive and thanks class members for their continued patience.
Are their any updates on the settlement? Are they really going to start sending out coupons and payments by the end of the summer?
I just left a message with The Federal Trade Commissioner. I suggest yall do the same this is ridiculous.
What the hell fall starts what September 23rd Korean posted on there website checks be mailed late summer. I know there not allowed to lie. Any new information or I’m start writing letters we’ve had enough of this everyone needs to move on.

what a freaking scam. it amazes me how government and big business can manipulate the system and get away with it. funny they are not held to same standards as us little folk. this settlement has been dragged out for months and we have been lied to repeatedly about when we would receive our vouchers/refunds. I think they were hoping we would all forget and their corrupt lawyers could just pocket it all. I am so disgusted with this company and with Rust. goes to show how little we all mean to corporations that can continually scam us and get away with it. what a joke.
