Korean Air Lines Co., Ltd. and Asiana Airlines Inc. have reached a $65 million class action lawsuit settlement resolving allegations they conspired to fix prices for air passenger travel between the U.S. and the Republic of Korea. If you bought a qualifying ticket between January 1, 2000 and August 1, 2007, you may be entitled to cash and coupons for future air passenger travel as part of the class action settlement.

The Korean Air settlement will resolve a class action lawsuit that claims the alleged conspiracy included meetings, conversations and communications in the U.S. and elsewhere between the two Defendants during which they agreed to establish artificially high prices for air passenger travel.

In cases separate from this class action lawsuit, brought by the United States Department of Justice, the Defendants pled guilty to criminal antitrust violations and agreed to pay a fine. Despite pleading guilty in the DOJ cases, Korean Air Lines and Asiana Airlines deny the allegations raised in the class action lawsuit but have agreed to a settlement to resolve the litigation.

The case is In Re: Korean Air Lines Co., Ltd., Antitrust Litigation, MDL No. 07-01891, U.S. District Court, Central District of California, Western Division.

UPDATE: On Feb. 8, 2016, a final hearing was scheduled and Judge Otero is expected to issue an order soon. Once the order is issued, the settlement funds and coupon codes will be distributed to Class Members who submitted a valid and timely Claim Form.

UPDATE 2: On Feb. 11, 2016, according to the settlement website, airline passengers who filed a claim in the Korean Air class action settlement should expect to receive a check and coupon code in April!
UPDATE 3: On April 21, 2016 the settlement website posted the following update: “We now expect that the distribution to claimants will occur in late May 2016.  Additional updates will appear on the website when the date for the distribution mailing is known. Thank you for your patience while the process is completed” Top Class Actions will continue to provide updates as we learn more. UPDATE 5: According to the Settlement Administrator, checks and coupon codes will be distributed to Class Members on June 27, 2016.

Second, PLEASE only submit claims you’re qualified for. Submitting false claims is not only illegal, it hurts the people who TRULY have a claim. Every false claim lowers the amount legitimate claimants can get, adds additional unneeded work to the settlement administrator, as they have to attempt to verify more claims (which delays payments for everyone), and it also makes settlement administrators much less likely to include internet notifications with groups like Top Class Actions as part of the advertising plan, which means YOU won’t hear about all of the settlements out there. False claims are a persistent problem and will result in less and less settlements getting listed on websites like Top Class Actions. Oh, and bragging about a false claim on social media is DUMB! Don’t you think settlement administrators are watching to see who’s dumb enough to comment or brag about doing something illegal? At a minimum those people will end up getting blacklisted and denied future claims, at a maximum you may start to see people get indicted for fraud. Remember, back in the 90s and early 2000s when we said, “They won’t ever go after anyone for downloading music illegally!” What happened? Many, MANY people got sued for thousands upon thousands of dollars and LOST.
Who’s Eligible

Class Members of the Korean Air settlement include anyone who purchased at least one ticket for air passenger travel on Asiana Airlines or Korean Air Lines. The purchase must have been:

  • Made in the United States;
  • For a flight originating in the U.S. and ending in Korean or a flight originating in Korea and ending in the U.S.; and
  • Made between January 1, 2000 and August 1, 2007.

Both businesses and individuals may be Class Members.

Potential Award

Class Members that submit a valid Claim Form will receive cash and coupons from the class action settlement, which will be distributed pro rata, based on the total number of qualifying purchases and valid Claim Forms submitted.

    We’re is the court house some of us need to attend tell judge, all the lies Rust told us we get paid late summer 2015 then a phonetic data base invention now our attorneys had to take Rust to court on Feb 8th to tell Judge what Rust has been doing to us. You know the GCG settlement administrations out of Washington state stole a of people’s money on the Burger King class action, are these companies that desperate.

    UPDATED: January 13, 2016

    Settlement Class Counsel filed a motion for distribution of the settlement funds (both cash and coupon) before Judge Otero, the judge overseeing the case. A hearing has been scheduled for February 8, 2016, and it is expected that the Judge will issue an order shortly thereafter. Once the order is issued, Rust, the claims administrator, can begin distributing the settlement funds and the coupons codes to claimants.

    We are nearing the end of the process and we appreciate your patience while the process is completed.

      now that they have created their fake website for coupons,i wonder how much will our check and coupons be now,RUST is going to burn in hell for the way he beat people out of money,that rightful belong to them,do any one know anyone know?

    Then the LAWYERS in the class action suit got their cut. Next there was to be a verification and

    distribution made to claimants. RUST Consulting was given that job. RUST consulting first verified

    the claimants’ applications. Next, RUST Consulting decided to build a data base to interact with

    Korean Air’s data base. (This likely was not necessary). Next RUST Consulting decided to build a

    data base to permit claimants to sell their coupons to others. (This likely was not necessary).

    So, why is RUST Consulting doing all of this extra work?? They are doing it to eat up the claimants

    cash awards. Rust Consulting is a company that makes a significant part of its revenue in Class Action Suits. Thus the claimants refunds cannot be distributed because the amount of cash refund is unknown until

    RUST Consulting completes all their extra work and gets paid from our cash awards. First of all Korean Air got us, next the LAWYERS got us, and now RUST Consulting is getting us. They are all eating up our cash refunds and the amount of the bonus coupons. Feels really good, doesn’t it?

    The amount of the cash refunds and bonus coupons are not known SINCE RUST is stilling developing a database to interact with Korean Airs data bases and creating another set of databases for the claimants to trade/sell their bonus coupons to others. RUST is using up as much of the money as they can for themselves, only after everything is completed and paid for, then they will calculate the cash awards and bonus coupon amounts. FIRST, the lawyers took their share, now RUST is eating up as much as they can. This process is no surprise to RUST since they make a significant part of their business doing this work for numerous class action suits. RUST knows what they are doing, they are trying to use up as much of our money as they can for their own business. LAWYERS first, RUST second, we last. We got srew*d by Korean Air, then LAWYERS and now RUST. Triple play. Nick01
