A $1.2 million settlement has been reached in a class action lawsuit alleging Inventurus Knowledge Solutions Inc. made automated balance-reminder phone calls on behalf of healthcare providers to consumers who had not consented to receive the calls, in violation of the Telephone Consumer Protection Act.
According to the health care providers TCPA class action lawsuit, Inventurus contracts with businesses in the healthcare industry and provides a variety of different services, including making automated calls to transmit messages to its clients’ customers.
If you received an automated telephone call on your cell phone from Inventurus reminding you about a balance you had with a healthcare provider, you may be entitled to a cash payment from the TCPA class action settlement.
The Telephone Consumer Protection Act is a federal law that prohibits the use of automated telephone dialing equipment or a prerecorded or artificial voice to call the cell phones of individuals who did not provide their prior express consent to receive automated calls.
Plaintiff Judith Flahive filed the Inventurus TCPA class action lawsuit on May 26, 2017 after she received unwanted calls on her cell phone about a debt she owed to a physical therapy clinic. Flahive says she notified Inventurus that she no longer wanted to receive automated calls, but she continued to receive them.
“Adding insult to injury, the recipients of these unauthorized calls are not only annoyed and frustrated, they are also forced to bear the costs of receiving these unsolicited and unauthorized prerecorded calls,” the Inventurus class action lawsuit alleges.
Inventurus denies any wrongdoing but agreed to settle the TCPA class action lawsuit to avoid the burden and expense of ongoing litigation.
Class Members who would like to opt out of or object to the healthcare providers TCPA settlement must do so no later than Oct. 13, 2017.
Who’s Eligible
Class Members of the Inventurus TCPA settlement include anyone who, between May 1, 2013 and Aug. 29, 2017, received an automated phone call on their cell phone from Inventurus that featured a prerecorded or artificial voice, and who did not consent to receive the call (or who revoked any prior consent).
Potential Award
Up to $200.
The amount each claimant will receive depends on several factors, including the total number of Class Members who submit timely and valid Claim Forms.
Proof of Purchase
N/A. Class Members must certify under the penalty of perjury that they received one or more automated phone calls on their cell phone from Inventurus between May 1, 2013 and Aug. 29, 2017, that they did not consent to receive the automated calls (or previously revoked their consent), and that they were the subscriber or authorized user of the cell phone number.
