Hapy Bear Surgery Center agreed to a class action lawsuit settlement to resolve claims it failed to protect patients from a 2023 data breach.

The Hapy Bear Surgery Center settlement benefits individuals whose personal information was exposed in the data security incident discovered on or about Dec. 27, 2023, including those who received a data breach notification. The company reportedly announced the breach in April 2024.

According to a class action lawsuit, Hapy Bear Surgery Center failed to prevent the data breach, which compromised sensitive patient information, including names, Social Security numbers, health insurance information and medical records. Plaintiffs in the case contend the company could have prevented the Hapy Bear Surgery Center data breach by implementing reasonable cybersecurity measures.

Hapy Bear Surgery Center is a pediatric dental surgery center in Tulare, California.

Hapy Bear Surgery Center hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve these allegations.

Under the terms of the Hapy Bear Surgery Center settlement, class members can receive up to $500 for ordinary out-of-pocket expenses, such as communication charges, bank fees, credit costs, monitoring expenses, professional fees and up to four hours of lost time at a rate of $25 per hour. Class members can also receive up to $7,500 for extraordinary out-of-pocket expenses, including unreimbursed monetary losses associated with fraud or identity theft. California class members are eligible for an additional $50 payment.

All class members are eligible for two years of credit monitoring services through the settlement. These services include three-bureau credit monitoring, dark web monitoring, real-time inquiry alerts and $1 million in identity theft insurance.

In addition to providing monetary benefits, Hapy Bear Surgery Center agreed to enhance its data security measures as part of the settlement.

The deadline for exclusion and objection was Jan. 6, 2025.

The final approval hearing for the Hapy Bear Surgery Center data breach settlement is scheduled for Feb. 24, 2025.

To receive settlement benefits, class members must submit a valid claim form by Feb. 4, 2025.
