GoAuto Insurance Co. agreed to a class action lawsuit settlement to resolve claims it failed to pay sales tax and transfer fees on total-loss claims.
The GoAuto Insurance settlement benefits Louisiana residents insured under a GoAuto motor vehicle policy with comprehensive and/or collision coverage who submitted a total-loss claim between May 16, 2012, and May 13, 2024, and did not retain the salvage vehicle.
Plaintiffs in the class action lawsuit accused GoAuto Insurance of failing to pay sales tax, registration and tag fees, title fees and other regulatory fees as part of the actual cash value of vehicles determined to be a total loss. GoAuto total loss policies allegedly caused consumers to lose money they were rightfully owed under state laws.
GoAuto Insurance is an insurance company that offers coverage in Louisiana, Nevada, California and other states.
GoAuto hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve these allegations.
Under the terms of the GoAuto Insurance settlement, class members can receive payments for unpaid sales tax and transfer fees that were applied to their total-loss claim payments. Exact payment amounts will vary depending on the sales tax and transfer fees each class member is owed. No payment estimates are available at this time.
The deadline for exclusion and objection is July 12, 2025.
The final approval hearing for the GoAuto total loss settlement is scheduled for Aug. 11, 2025.
To receive settlement benefits, class members must submit a valid claim form by Sept. 11, 2025.
Who’s Eligible
Louisiana citizens insured under a GoAuto motor vehicle policy with comprehensive and/or collision coverage who submitted a covered first-party physical damage claim that was adjusted as a total loss and resulted in a total-loss payment from GoAuto between May 16, 2012, and May 13, 2024, and who did not retain the salvage vehicle.
