Empire Parking Services has agreed to a class action lawsuit settlement to resolve claims it unlawfully booted vehicles in Atlanta, Sandy Springs, Decatur, and the counties of Cobb, DeKalb, and Fulton.

The Empire Parking Services class action settlement benefits individuals who paid to have a boot removed from a vehicle booted by Empire Parking Services in Atlanta, Sandy Springs, Decatur, Cobb County, Dekalb County, and/or Fulton County between Feb. 3, 2012, and Dec. 12, 2018.

Empire Parking Services is a parking management company that operates in Atlanta and other cities. Several class action lawsuits claimed the company unlawfully booted customers’ vehicles. Booting is the practice of attaching a device to a vehicle’s wheel or tire to prohibit movement.

The Empire Parking Services class action lawsuit claims the company violated Georgia law by booting vehicles from non-compliant lots. Under Georgia law, vehicle booting can only be done on lots that are clearly marked with signage and have a written policy in place. The plaintiffs in the case say Empire Parking Services failed to comply with these requirements.

Empire Parking Services has not admitted any wrongdoing but agreed to pay an undisclosed sum to resolve these allegations.

Under the terms of the Empire Parking Services class action settlement, class members can receive a cash payment of up to $30 per claim. However, if a large number of claims are filed, payments may be reduced on a pro rata basis.

The deadline for exclusion and objection is Sept. 2, 2025.

The final approval hearing for the Empire Parking Services settlement is scheduled for Sept. 30, 2025.

To receive settlement benefits, class members must submit a valid claim form by Oct. 23, 2025.


Who’s Eligible

The settlement benefits individuals who paid to have a boot removed from their vehicle that was booted by Empire Parking Services in Atlanta, Sandy Springs, or Decatur, Georgia, or Cobb, DeKalb, or Fulton counties between Feb. 3, 2012, and Dec. 12, 2018. To qualify for a payment, class members must have been driving the vehicle that was booted and personally paid the booting fee.

Potential Award

Up to $30.

Proof of Purchase

Class members must submit documentation showing they owned or drove a vehicle that was booted by EPS during the class period or that they paid to have a boot removed by EPS. The documentation must show the booting occurred in Atlanta, Sandy Springs or Decatur or Cobb, DeKalb or Fulton counties between Feb. 3, 2012, and Dec. 12, 2018.
