Those residing near the Sunshine Canyon Landfill in Sylmar, Calif. could get cash from a $3.5 million Browning-Ferris Industries odor class action settlement.
The California Browning-Ferris Industries odor class action settlement was reached after plaintiffs alleged that a local landfill was emitting noxious odors, along with pollutants, into the surrounding area.
According to the landfill class action lawsuit, the problem dates back to 2009 and thousands of residents of the city of Sylmar have submitted complaints about the fumes coming from the dump.
The plaintiffs said that the odor from the Sunshine Canyon Landfill was so bad that they not only avoided inviting people over to their homes, they often had to leave to avoid the stench.
Under the terms of the class action settlement, the company that runs the Sunshine Canyon Landfill will pay $3.5 million into a settlement fund.
Though Browning-Ferris Industries admits no wrongdoing, it has agreed to make improvements to the landfill to help with gas flare capacity, gas collection measures, odor and dust control. It will also plant vegetation to help screen the area between the landfill and the Mission Tierra neighborhood in Sylmar, Calif.
Class Members can also claim a portion of the fund, approximately $771.54 and, in some cases, up to $15,430.90, under the terms of the Sunshine Canyon Landfill odor class action settlement if they submit a Claim Form by Sept. 21, 2018.
Class Members who wish to exclude themselves or object to the California Browning-Ferris Industries odor class action settlement must do so by Sept. 21, 2018.
Who’s Eligible
Class Members include “all persons who have resided in a Housing Unit (any single family or multi-family residential unit, including a condominium or apartment) located in whole or in part within the Class Area, at any time since December 11, 2009.”
The Class Area includes a Southern Class Area and Northern Class Area. Descriptions of the areas can be found on the settlement website. A map of the affected area can be found here.
Potential Award
$771.54 to $15,430.90 depending on number of complaints made and the claim rate of the settlement.
Proof of Purchase
Claim Form, address of property occupied in the Covered Area, copy of government issued photo identification, and proof of status of renter or owner-occupant, including a tax or utility bill.

Just received notification from an “inside” source that issues have been resolved and checks will be mailed sometime next week – unless of course something new comes up. But this time, it seems real.

For anyone who would like to expedite payments email Mike Arias, lead attorney for this settlement. Attorneys got paid back in March, never mind almost $ 2 mil. and they have fiduciary duty to us. Let’s get this thing moving! Enough excuses from them!
so does any one know if we are getting $15,430 or $771.54 does any one know or not.
Any updates anyone? Are we still waiting for something or should we just consider this done?
I did try calling per everyone’s advice below, the law firms involved routed me to the general website for the lawsuit, and those people said the case wasn’t resolved. It’s impossible to get an answer.

I tried the law firms directly and they referred me back to the settlement website, who, when I phone, tell me this isn’t resolved.
I just got a letter asking me to fill out a form and I need to provide my social security number. It says money I will be receiving( anything over $600) will be reported to the IRS. I’m not sure if this is real or what? I’m worried that this is really a scam and they just want to get additional info from me. Anybody else received this letter?
