Those residing near the Sunshine Canyon Landfill in Sylmar, Calif. could get cash from a $3.5 million Browning-Ferris Industries odor class action settlement.
The California Browning-Ferris Industries odor class action settlement was reached after plaintiffs alleged that a local landfill was emitting noxious odors, along with pollutants, into the surrounding area.
According to the landfill class action lawsuit, the problem dates back to 2009 and thousands of residents of the city of Sylmar have submitted complaints about the fumes coming from the dump.
The plaintiffs said that the odor from the Sunshine Canyon Landfill was so bad that they not only avoided inviting people over to their homes, they often had to leave to avoid the stench.
Under the terms of the class action settlement, the company that runs the Sunshine Canyon Landfill will pay $3.5 million into a settlement fund.
Though Browning-Ferris Industries admits no wrongdoing, it has agreed to make improvements to the landfill to help with gas flare capacity, gas collection measures, odor and dust control. It will also plant vegetation to help screen the area between the landfill and the Mission Tierra neighborhood in Sylmar, Calif.
Class Members can also claim a portion of the fund, approximately $771.54 and, in some cases, up to $15,430.90, under the terms of the Sunshine Canyon Landfill odor class action settlement if they submit a Claim Form by Sept. 21, 2018.
Class Members who wish to exclude themselves or object to the California Browning-Ferris Industries odor class action settlement must do so by Sept. 21, 2018.
Who’s Eligible
Class Members include “all persons who have resided in a Housing Unit (any single family or multi-family residential unit, including a condominium or apartment) located in whole or in part within the Class Area, at any time since December 11, 2009.”
The Class Area includes a Southern Class Area and Northern Class Area. Descriptions of the areas can be found on the settlement website. A map of the affected area can be found here.
Potential Award
$771.54 to $15,430.90 depending on number of complaints made and the claim rate of the settlement.
Proof of Purchase
Claim Form, address of property occupied in the Covered Area, copy of government issued photo identification, and proof of status of renter or owner-occupant, including a tax or utility bill.

1-877-291-4937 and they said that these are the people that need to to talk to plus ask them about your checks. plus they are the ones that get the money from the company that needs to pay all the people that got sick from the land fill.
I called that # today, they said the court case hasn’t been finalized. They are waiting for the court to make their final decision.

This comment section is for us to help each other and provide info on check distribution, updates and let each other know what is going on from whomever they may have contacted. If you just going on here to lead people on and wont tell us what you were told and acting like a kid keeping it a secret and telling us to call ourselves. Then why even comment on it if you have nothing to share other then I know something, but im not telling you nahnahnah. Grow up either help and share or don’t even bother us with that nonsense.
Artie and everyone. I didn’t call call center, I went to the Source at the suggestion of Linda. There 2 law firms represented us the plaintiff. I emailed and got response from an Attorneys that checks were supposed to be mailed on 9. KCC experiences some difficulties and attorneys are trying to figure out what is the problem So, whatever call center people were telling you is total bs. Don’t assume that checks had being printing and just sit there. In one other settlement handled by KCC ast year, checks had been mailed and whoever called KCC call center got response that they don’t know when checks will be mailed! Here is your answer. And for whoever reading that – should of do the same and contact Attorneys instead of demanding answers from others! The more people would contact Attorneys, more pressure they would have to work for us and figure out what is the problem with KCC! Kudos to Linda, who figured this out!!!
I just called the number above and I was told that they are just awaiting instructions on when the distribution of the checks will be done. They were originally told that anticipated date for distribution was mid-May but they haven’t heard anything after that. My understanding based on what I was told is that, checks has already been printed out and just awaiting instructions for when to start mailing it. Hopefully this information helps.
so i called the phone up top on this link and said that they only update their that there is on this link nothing has been told to them what is going on about any payment’s and that they would let people know what is going on when they hear back from settlement site they will update when payment go’s out. so i don’t know what any told any one but that is what i was told over the phone.
Linda, why don’t you just relay to us what they told you. Instead of being all secretive and playing games. What is the reason that you have to act like this. You sure read everyone else’s information and appreciate what they offer. But you call and play cat and dog with us and wont reveal it .
