Consumers who had a checking or savings account with Bank of America (BOA) and were charged a retry transaction, overdraft, nonsufficient funds (NSF), or intrabank transaction fee may be eligible for a payment thanks to a $75 million BOA fees class action settlement.

Settlement Class Members include Bank of America customers who had a checking and/or savings account and were charged one of the following fees between July 1, 2014, and July 29, 2021: retry transaction fee, Intrabank transaction fee, NSF fee, or overdraft fee.

Plaintiffs in a class action lawsuit allege Bank of America charged its customers improper fees systematically in a multipronged effort to earn more profit.ย 

The plaintiffs further say multiple BOA fees would get charged for a single transaction. Together, plaintiffs say, the bankโ€™s practice of charging these fees would force customers into a cycle of deceptive and improper charges.

Bank of America disputes the plaintiffsโ€™ allegations, and the company denies its actions were improper.ย 

The Court has not made any ruling about the actions of Bank of America, so no determination of guilt has been made in the BOA fees class action lawsuit.ย 

Despite that, both Bank of America and the plaintiffs have considered the risks and costs of continuing the class action lawsuit. Both parties believe the settlement is in the best interests of all Class Members and the company itself.

According to the settlement, the $75 million balance will get paid out on a pro rata basis after attorneysโ€™ fees, service awards, and the costs of administering the settlement have been deducted.ย 

Current customers will get a credit on their accounts for the amount theyโ€™re entitled to receive, while former customers will receive a check.

Also as part of the settlement, Bank of America has also agreed to change certain practices for at least five years. It will stop assessing fees on retry transactions and will implement changes to its consumer account disclosures.

Class Members who do not wish to participate in the settlement must exclude themselves. By doing so, Class Members can continue pursuing any individual claims against Bank of America, but they will not receive any payment from this settlement.

Class Members who wish to continue participating in the class action lawsuit but are not happy with the settlement have a right to object.

The deadline to opt out of or object to the BOA fees class action settlement is Nov. 11, 2021.

      If your in the Morris case i think they start to send chekc after Jan 18. Jan 18 was the final hearing they got 30 days after that to send u your check

    Today I received my ck for $1.82. I was overcharged for atm fees for doing a balance check only from ATM at the grocery store. The stores ATM had no charge for balance inq. But the bank charged a lot.
    Itโ€™s very sad the way the system works.

    $0.91โ€ฆReally? I mean the paper and ink to print the check cost more! They took way more than that in fees!

    So, I too got a check for under $5, but the paperwork on that says Farrell v BOA NA Settlement. I feel many of us were looped into both lawsuits because they are going after slightly different things. This lawsuit didnโ€™t have final approval scheduled until January 18, 2022. Having been part of other class action lawsuits, the payment can not be released until after final approval from the judge.

    Im getting 800 dollars from a 8 million lawsuit didnโ€™t even have no money taken from me but get only 50 cent for a bank lawsuit that cost me thousands for years something wrong NO ITS THE LAWYER AND THE COURTS GET THE MONEY NO EXPECT TO GET Yโ€™ALL MONEY BACK .25 CENT THE MOST

      Well after all the issues, stress, and irritation dealing with bank of americas overdraft fee actions, I got $3.64. This was an insult

    How pathetic! I received a check for $.91. This is so typical, and we have not a chance of standing up to get justice! I hope the lawyers and the banks get what is really due!!!! Shameless and have destroyed our society and faith people once had or should have!!!

    These lawsuits are designed to be a slap on the hand for the institution and not reparation for improper practices. The lawyers get the lions share and each litigant gets a monetary amount. If thatโ€™s $0.01, thatโ€™s money.

    I was charged $35 (4 times) because they retried the same check 4 times in one night!!!! My payroll check hit the same night the insufficient charge came through for $8.29 McDonaldโ€™s charge โ€“ they say they run deposits LAST. (So they can collect fees).

    I worked for BofA at the time!!!!!!

    I received $1.82 of the $140. Iโ€™m looking into filing a small claims against Bank of America. If thatโ€™s not an option Iโ€™m contacting customer service to pressure for credits and bombarding their social media. This was years ago but Iโ€™m not letting it go.

      Was the $1.82 from the previous settlement or from the $75 million? Iโ€™m curious what kind of โ€œpayoutโ€ there will actually be since, like you said, the attorneys get the majority and I know over the years they have taken several hundred easily from meโ€ฆ

        Iโ€™ve lost thousands
        Every month I took out rent money that was due the 3rd week of the money not knowing that our SS check changed to the 3rd. So the money was never in there. Rent was 1200, Boa paid it and then charged me 35 Dollars and then 35 dollars every five days! Plus 35 dollars for 4 other bills every five days.
