Consumers who purchased AmeriGas or Blue Rhino pre-filled tanks may be eligible to claim up to $125 without proof of purchase as part of a $6.5 million settlement over the amount of propane in the tanks.

Those who are eligible to make a claim in this class action settlement include individuals who bought or exchanged one or more AmeriGas and/or Blue Rhino pre-filled propane tanks between Dec. 1, 2009, and Nov. 30, 2020.

Without proof of purchase, Class Members will be eligible for up to $2.50 per tank for up to 50 tanks, or $125.  Class Members who provide proof of purchase are eligible for up to $5 per tank, with no limit on the number of tanks that can be claimed.

This class action settlement resolves claims that AmeriGas and Blue Rhino allegedly colluded together to lower the amount of propane in their pre-filled propane tanks from 17 pounds to 15 pounds without also reducing the price, resulting in inflated prices for propane customers.

While consumers who purchased either AmeriGas or Blue Rhino propane tanks may be affected by this settlement, it only resolves the claims made against AmeriGas; the Blue Rhino case is continuing in court.

AmeriGas has agreed to end the litigation with this settlement, but AmeriGas does not admit to any wrongdoing. 

The settlement agreement established two Classes.

The Indirect Purchaser Settlement Class is made up of those who purchased AmeriGas or Blue Rhino propane tanks, other than a wholesale purchase directly from AmeriGas or Blue Rhino for resale, in Arizona, California, Iowa, Maine, Michigan, Minnesota, Nevada, New Mexico, North Carolina, North Dakota, South Dakota, Utah or West Virginia during the Class Period.

The Direct Purchaser Settlement Class is made up of consumers nationwide who purchased one of the propane tanks directly from AmeriGas or Blue Rhino via a vending machine at retailers or other locations, or paid one of the companies directly through a vending machine to exchange a previously purchased propane tank, other than a wholesale purchase intended for resale.

A fairness hearing is scheduled for March 31, 2021.

The deadline for filing a Claim Form, opting out or objecting to the settlement is March 8, 2021.

Who’s Eligible

Potential Award
  • With proof of purchase, Class Members will be eligible to claim a cash payment of $5 for each tank purchased. There is no limit to the number of tanks that may be claimed with proof of purchase.
  • Without proof of purchase, Class Members may claim $2.50 for each tank, up to 50 propane tanks, for a maximum of $125.
Proof of Purchase

Valid forms of proof of purchase include store receipts, credit card receipts, UPC codes from propane tank labels and store records. Consumers with something else they think confirms the purchase should submit it along with their Claim Form. The Claims Administrator will determine whether the proof is sufficient.

    Under Documents, you will find a copy of the claim form which has 2 options for payment:
    I would like to receive my payment if my claim is determined to be eligible:
    by Physical Check: [ ] Digital Payment (You must provide a valid email address): [ ]

    I called on 6 July to inquire about the digital payments. The rep stated she wasn’t aware that any distribution had been made as they were still waiting on the court decision from 30 March hearing. I informed her physical checks dated 6/28/21 are being reported as received in the mail with image of checks as proof. Claimants need to call 855-940-5296, press 2 to notify the Settlement Administrator if you opted for digital payment and haven’t received it.

      “The initial wave of confirmation emails were issued and we are currently reviewing to confirm validity. We anticipate that the payment waves will start to issue in the next two weeks.”

    I received a check from the PRE-FILLED PROPANE TANK ANTITRUST for $241.65. Check is dated 6/28 & I live in the state of Indiana. Thank you very very much topclassactions.com for making me aware of the fact that i was eligible to receive a refund as part of the settlement in this lawsuit. If it wasn’t for this well maintained and easy to navigate website along with the emails that you send out, I would have never known anything whatsoever about this settlement. Thanks again!

        According to the settlement administrator there has been no payments issued to date. In fact, the payments are limited to 50 tanks at $2.50 per tank or a maximum of $125.00 .

        So I do not know were you people have gotten your checks from but it was not the from this settlement

      I don’t think PayPal was an option. I normally choose PayPal, but got a check.
