Checkers and Rally’s customers may be able to benefit from a data breach class action settlement that provides four $5 vouchers or up to $5,000 in expense reimbursement.
The settlement benefits consumers who used a credit or debit card at certain Checkers and Rally’s restaurants between Dec. 17, 2015 and Oct. 12, 2019. Find the full list of affected restaurants and time periods here.
Plaintiffs in the Checkers and Rally’s class action lawsuit alleged that the restaurant mishandled a data breach which affected 100 restaurant locations around the country from 2015 to 2019. Allegedly, the breach went undetected for this time and compromised consumer payment information such as card numbers, verification codes, expiration dates, and more.
The plaintiffs claimed that Checkers and Rally’s restaurants should have been aware of the risk of data breach issues due to the increasing threat posed by hackers. However, the Checkers and Rally’s class action lawsuit alleged that, “despite all of this publicly available knowledge of the continued compromises of personal information in the hands of other third parties, such as national restaurant chains, [Checkers’] approach to maintaining the privacy of [customer information] was lackadaisical, cavalier, reckless, or at the very least, negligent.”
As a result of this alleged negligence, countless consumers like the plaintiffs reportedly had their information compromised – putting them at risk for theft and fraud.
Checkers and Rally’s have not admitted any wrongdoing but agreed to resolve the claims against them with this class action settlement. The deal allows the restaurant to resolve the allegations while also providing secure relief to plaintiffs and Class Members. By settling the case, all involved parties don’t have to face the expenses and risks of further litigation.
Under the Checkers and Rally’s restaurant class action settlement, Class Members can collect reimbursement for data breach expenses or several restaurant vouchers.
Class Members are eligible for up to $5,000 in reimbursement for documented out-of-pocket expenses and lost time. Expenses may include bank fees, fraudulent charges, and more. Lost time could have been spent mitigating the effects of the data breach and is reimbursed at a rate of $20 per hour, up to 4 hours.
The settlement alternatively provides vouchers which can be redeemed at any Checkers and Rally’s restaurant. The vouchers are worth $5 each – with up to four vouchers available to each Class Member.
Class Members can chose either form of compensation from the settlement. In order to benefit from the settlement, Class Members must file a valid claim form by Oct. 28, 2020. For reimbursement claims, documentation of expenses and lost time is required.
The deadline for exclusion and objection is Oct. 28, 2020. The final approval hearing for the settlement is scheduled for Dec. 8, 2020.

Is anyone have issues redeeming the $5 x 4 coupons? I went today and the cashier told me the voucher coupons weren’t being recognized in the system.

That’s frustrating… Did you just pay cash? If you already ordered your food I imagine you’d feel like you had to. Hoping you contacted the settlement administrator. Or try going to a different Checkers location and see if it happens there, IDK.
The nice cashier lady just let me get two sandwiches for free. She told me to contact the settlement people to sort it out because on her end she couldn’t do anything to solve the issue. I’ve sent an e-mail to the settlement administrator asking what the heck is going on.

Fake news no one got anything more than vouchers. Stacy clearly is in need of attention in her less than eventful social life. Take a pic of the check like everyone else does when they receive money
