Party City has agreed to a class action settlement to resolve claims that they failed to redact expiration dates on American Express receipts.

The settlement benefits individuals who made a credit or debit card transaction with an American Express card at a Party City between March 1, 2016 and Nov. 2, 2016.

Plaintiffs in the Party City receipts class action lawsuit claimed that the retailer failed to follow federal law by redacting the expiration date on American Express transactions. Allegedly, this failure put cardholders at risk for fraud and violated their rights under federal laws.

The plaintiffs contended that Party City violated the Fair and Accurate Credit Transactions Act (FACTA) by failing to redact the expiration date. This multi-faceted law helps protect consumer information by limiting the information allowed on electronically printed receipts.

Under FACTA, no amount of a card’s expiration date can be printed on a receipt. Similarly, only the last 5 digits can be printed on a receipt. This standardization of information aims to protect payment card info in the event of a data breach.

Party City has not admitted any wrongdoing under FACTA or other laws but has agreed to resolve the claims against them in a class action settlement.

Under the terms of the Party City receipts class action settlement, Class Members can receive a cash value certificate worth up to $9. These certificates do not expire and can be used to save money on an online purchase or in-person transaction at a Party City location.

No claim form is required for consumers to receive their cash value certificate. Instead, Party City records will reportedly be used to verify purchases made during the eligible period. This information will be used to disperse benefits to Class Members.

The Party City receipts class action settlement will also provide up to $10,000 service awards to each plaintiff for their work as Class representatives and up to $1.575 million in attorneys’ fees and court costs.

Class Members do have the opportunity to exclude themselves or object to the Party City receipts class action settlement, though the deadline to do so is Sept. 19, 2020. Exclusion allows Class Members to retain their claims against Party City but means that they will not receive compensation. Objection allows Class Members to remain in the Class but voice their concerns with some or all of the settlement terms.

The Party City receipts class action settlement will have a final approval hearing held on Oct. 27, 2020. During this hearing, the court will decide whether or not the settlement is fair and if it can move forward to the payment stage.

Typically, Class Members would be invited to attend these hearings but not required to do so. However, due to coronavirus measures, this has changed and hearings are often held via Zoom meetings.

Who’s Eligible

Individuals who made a credit or debit card transaction with an American Express card at a Party City between March 1, 2016 and Nov. 2, 2016.

Potential Award

A cash value certificate worth $9.

The certificated can be used online or in-store (upon request) at any Party City to save up to $9.
