A class action settlement worth over $11 million has been reached to resolve claims that Lexington Law Firm, based in North Salt Lake, Utah, placed unsolicited calls and texts.

The Lexington Law settlement benefits individuals who received a phone call or text message from Lexington Law Firm on or after July 12, 2013 based on information gathered by third-party lead generators (TK Media Inc., Capital Leads LLC, Fluent LLC, and Credit Sesame).

Also included in the settlement are individuals who had a phone conversation with a Lexington Law Firm representative on or after July 12, 2013 where the firm obtained a copy of their credit report but did not sign up for Lexington’s credit repair services or opt out of text messages from the company.

Several plaintiffs have filed class action lawsuits against Lexington Law Firm, alleging that the firm sent them unsolicited text messages and phone calls advertising their credit repair and monitoring services.

For example, plaintiff Marcelo Pena allegedly received text messages from Lexington every day for three days. According to his class action lawsuit, these texts encouraged Pena to call the firm and utilize their services.

“Defendant’s unsolicited text messages caused Plaintiff actual harm, including invasion of his privacy, aggravation, annoyance, intrusion on seclusion, trespass, and conversion,” the Lexington Law Firm TPCA class action alleged.

According to the plaintiffs, these calls and texts violated the Telephone Consumer Protection Act, or TCPA. This federal law protects consumers from unsolicited telemarketing behaviors and requires businesses to obtain prior express written consent before sending calls and texts. Businesses which violate TCPA may be ordered to pay up to $1,500 in statutory damages for each violation.

Lexington Law Firm has not admitted any wrongdoing but has agreed to pay over $11.45 million in consumer payments to resolve the claims against them. This fund will provide cash payments of $6.15 to Class Members.

The class action settlement will also provide service awards of $2,500 for each plaintiff and attorneys’ fees of $1.45 million.

In order to benefit from the settlement, Class Members need to file a valid claim form by May 4, 2020. Any requests for exclusion or objections to the settlement terms must be filed by Feb. 26, 2020. The final approval hearing for the Lexington Law Firm TCPA class action settlement is scheduled for March 31, 2020.

Who’s Eligible

      It’s 2024. I never heard anything. I thought it was a scam as well. Have you heard anything?Did you get anything, from this? I had them since 2016 and credit repair simultaneously saying monthly and my credit still wasn’t great.. please let me know
