ATM withdrawal from Digital Federal Credit Union

Digital Federal Credit Union recently agreed to pay $1.8 million to resolve claims that they improperly charged overdraft fees to their customers.

The settlement will benefit individuals who had a checking account with Digital Federal Credit Union and were charged (a) an overdraft fee on any transaction between June 15, 2012 and June 15, 2019. Digital Federal Credit Union members who were charged an overdraft fee on an ATM or debit card transaction between June 15, 2017 and Sept. 1, 2018 also qualify for the settlement.

Plaintiff Brandi Salls filed a class action lawsuit against Digital Federal Credit Union in June 2018, claiming that the credit union had confusing overdraft policies which resulting in unnecessary fees. Salls was allegedly charged several overdraft fees when she had a sufficient balance in her account.

The credit union attempted to have the overdraft class action dismissed but they were not successful. In November 2018, the presiding federal judge determined that the Digital Federal Credit Union class action could move forward based on a lack of information included in the credit union’s overdraft disclosure.

Digital Federal Credit Union has not admitted any wrongdoing but agreed to pay $1.8 million to resolve the class action allegations against them. Additionally, the credit union will forgive around $766,000 in improper overdraft fees which have not yet been collected.

The settlement also requires Digital Federal Credit Union to make changes to the way they charge overdraft fees on certain transactions. According to the settlement website, these changes will result in savings of $467,000 in overdraft fees each year.

Under the settlement, Class Members will receive a share of the settlement fund based on the number of eligible overdraft fees they have paid. Each Class Member’s proportional share will depend on the number of eligible overdraft fees and the net settlement fund amount after fees, costs, and awards are deducted from the $1.8 million.

No Claim Form is needed in order to participate in the settlement. The deadline to exclude yourself to the settlement is Nov. 5, 2019. The deadline to object to the settlement is Nov. 26, 2019. The final approval hearing for the settlement is Dec. 19, 2019.

Who’s Eligible

Individuals who had a checking account with Digital Federal Credit Union and who were charged (a) an overdraft fee on any transaction between June 15, 2012 and June 15, 2019 and/or (b) an overdraft fee on an ATM or debit card transaction between June 15, 2017 and Sept. 1, 2018.

Potential Award

Varies. Each Class Member will receive a share of the net settlement fund after costs and fees are deducted. Payment amounts will be proportional to the amount of eligible overdraft fees they paid.

Proof of Purchase

N/A. Eligible overdraft fees will be identified using the defendant’s records.
