The Coca-Cola Company has agreed to pay $2.45 million to resolve allegations that their Seagram’s Ginger Ale products are falsely labeled as “Made With Real Ginger.”

Individuals who purchased Seagram’s Ginger Ale between April 1, 2013 and June 13, 2019 are entitled to submit a claim on or before September 5, 2019 to obtain a cash benefit.

Plaintiff Jackie Fitzhenry-Russell filed her class action lawsuit against Coca-Cola in December 2016. She claimed that Seagram’s Ginger Ale is deceptively marketed as “Made with Real Ginger” because the beverage does not contain any real ginger.

Instead of containing real ginger root, an ingredient consumers associate with health benefits, Seagram’s Ginger Ale is reportedly flavored with high fructose corn syrup, citric acid, and a chemical flavoring compound meant to mimic the taste of ginger.

In February 2019, Fitzhenry-Russell and Coca-Cola participated in mediation that resulted in the $2.45 million settlement agreement. Coca-Cola does not admit any wrongdoing by choosing to settle the case against it.

The settlement will provide payments to Seagram’s Ginger Ale purchasers between $4 and $80 per household. The payment amount depends on the number of units claimed and whether or not proof of purchase is provided. More information is available in the “Potential Award” section below.

In order to receive payment from the settlement, Class Members must file a valid claim by Sept. 5, 2019.

In addition to providing payments to Class Members, Coca-Cola has also agreed to remove the “Made from Real Ginger” claim from the Seagram’s Ginger Ale product labeling. Any leftover money from the settlement will be donated to two organizations furthering consumer protection: The National Consumer League and The Better Business Bureau.

The deadline to file a request for exclusion or object to the settlement is Sept. 5, 2019. The final approval hearing for the settlement is scheduled for Oct. 3, 2019.

Who’s Eligible

Individuals who purchased any flavor of Seagram’s Ginger Ale product between April 1, 2013 and June 13, 2019. A 2-liter bottle, a 20-ounce bottle, a 12-pack of 12-ounce cans, or a 10-pack of 7.5-ounce cans are considered a single unit of the product.

Potential Award

Up to $80 per household.

Claimants will be compensated up to $0.80 per unit purchased. Claims for 1-5 units will be compensated with $4. If Claimants do not provide proof of purchase with their claim, they can claim up to 13 units per household to receive a payment of $10.40.

With proof of purchase, Class Members can collect up to $80 for 100 units – as long as at least 87 of these units are accompanied with proof of purchase.

Proof of Purchase

Proof of purchase is required for consumers who wish to claim more than 13 units. Proof of purchase is a receipt or other documentation from a third-party commercial source that reasonably establishes the fact and date of purchase of the products.
