Ford Focus and Fiesta owners in Canada who say their cars suffered from a defective transmission that caused the vehicles to kick and jerk could get close to $3,000 in cash or $5,800 in vehicle discount certificates from a class action settlement.

Although the deadline to file a claim based on repairs done prior to June 26, 2019 already passed, claims based on future repairs, occurring after June 26, 2019, can still be submitted 180 days from the service visit date.

Class Members include those who owned or leased a 2011 to 2016 Ford Fiesta or a Ford Focus model year 2012 to 2016 in Canada that was equipped with a PowerShift Transmission.

Class Members must have visited an authorized Ford dealer on multiple occasions because of the defect and repairs to the transmission, software flashes, a replacement clutch, or continuing problems must have or are still occurring.

The automaker was hit with the Canada Ford transmission class action lawsuit over consumer complaints that model year 2011 through 2016 Fiestas and 2012-2016 Focuses were afflicted with a transmission defect.

According to the plaintiffs, the defect causes serious safety concerns for passengers, as well as other vehicles on the road.

The Canada Ford transmission class action lawsuit claims the defect could cause affected vehicles to accelerate suddenly and without warning. The complaint also alleged that the affected vehicles were prone to skipping, bucking, and jerking unexpectedly. Further, drivers could experience delayed acceleration.

The plaintiffs say they and other Fiesta and Focus owners were often required to pay out-of-pocket to fix the problem.

Additionally, the Canada Ford transmission class action lawsuit contends that Class Members would not have purchased or paid as much for the vehicles had they known they had the defect.

The automaker denied any wrongdoing but agreed to enter into the Canada Ford class action settlement.

Under the terms of the settlement agreement, Class Members can claim a cash payment or a partial refund of the purchase price of their Ford Fiesta or Ford Focus, depending on the condition and repairs their vehicle required. Class Members can claim different amounts based on the number of service visits and type of repairs completed.

Class Members seeking to claim up to $2,932 in cash or a $5,864 in a discount certificate must have experienced three or more service visits to an authorized Ford dealer, replacement of a qualifying hardware part in their transmission during each visit, and the visits must have occurred within seven years or the first 160,000 kilometers from when or where the vehicle was manufactured or first delivered.

Each Class Member must have owned or leased the affected vehicle during the visits as well.

Class Members can also make a claim if they took their Ford Fiesta or Focus in for service at an authorized Ford dealer for three or more software flashes. Class Members can claim up to $65 for each visit for a maximum payment of $780.

Under the terms of the Canada Ford transmission class action settlement, Ford Fiesta and Ford Focus owners can claim reimbursement for the replacement of two or more clutches on cars manufactured after June 5, 2013. Replacements must have occurred within five years and 100,000 kilometers of manufacture.

In addition, Ford may offer to purchase vehicles from Class Members whose qualifying Ford Fiestas or Ford Focuses are still having transmission problems and who have taken the vehicle for two or more service visits.

To make a claim, Class Members must submit the VIN of the vehicle, the name and address of the Ford dealer where their car was serviced, and a description of the service, along with proof that they owned or leased the car at the time of service. Claims can be submitted online or via mail.

The deadlines to opt out of or object to the Canada Ford transmission class action settlement passed on March 5, 2019. The settlement received final approval on March 18, 2019.

Who’s Eligible

Class Members include those who purchased or leased a 2012-2016 Ford Focus or a 2011-2016 Ford Fiesta with a PowerShift dual clutch transmission in Canada and experienced transmission problems. Class Members must have taken their vehicle into an authorized Ford service center for repair.

Potential Award

Up to $5,864 in Vehicle Discount Certificates or up to $2,932 in cash.

  • “If an authorized Ford dealer performed three or more transmission software flashes on your Class Vehicle, you may be entitled to cash payments ranging from $65 to $780, depending on the number of service visits.
  • If an authorized Ford dealer replaced three or more qualifying hardware parts in your PowerShift Transmission while you owned the Class Vehicle, you may be entitled to cash payments ranging from $252 to $2,932 or Vehicle Discount Certificates ranging in value from $504 to $5,864, depending on the number of service visits.
  • If your Class Vehicle was manufactured after June 5, 2013, and two or more clutch replacements were performed on your Class Vehicle under warranty, and you had to pay for a clutch replacement after warranty, you may qualify for reimbursement.
  • Alternatively, you may be entitled to ‘Alternative Benefits’, which are designed to compensate Class Members with ongoing clutch malfunctions by refunding the entire cost of purchasing or leasing the Class Vehicle, less a reduction for the usage of the Class Vehicle and the residual value of the Class Vehicle at the time the claim is submitted, with Class Members keeping the vehicle or being offered a repurchase by Ford.”
Proof of Purchase

Class Members must provide their vehicle’s VIN, the name and address of the Ford Dealer that performed the services, a description of the services, and proof that the Class Member owned or leased the vehicle at the time of service.

    6 month wait for the part to replace the TCM without any transportation assistance while it sits at the dealership…, can one repair with aftermarket parts and engage a small claims court action against Ford Canada?

      I am also having the same issue.. car has been sitting at dealership since beginning of July .. waiting on a part … my car wouldn’t reverse anymore it’s been a piece of crap the entire time .. multiple problems … what can we do?!?

        I hate this car! It was my wife’s. All the transmission problems discussed for years with multiple visits to Ford dealership. I finally just replaced the transmission myself. But no reverse on the one installed??? I changed the “b” solenoid and got reverse working.. Found a guy on marketplace to reflash the transmission control module. It is working and for sale. Only took 15 minutes but these transmissions will never work for any reliability. I feel bad for all of us who got sucked into this premeditated Ford fraud.

    The United States already has finalized a class action lawsuit for Ford’s PowerShift. The Canadian class action happened later.

    In 2015, the transmission control module failed In my 2012 Ford Focus and caused the shift forks in the transmission to move back and forth erratically and disengage and engage the clutches at will. This happened one week after a dealership updated the ECU (car on-board computer) to display a fault on the dashboard that the transmission is failing. Thankfully it happened at a gasoline forecourt.

    Thanks Ford for programming the ECU to alert to a transmission failure when it actually happened, and not before. I tried to engage reverse, and – oh – no reverse gear!

    When I tried to brake the car at low speed, it stalled when the brakes were fully applied. Apparently the clutch didn’t engage when I came to a stop!

    After the dashboard lit up like a Christmas tree, I had the car towed home.

    Thankfully I stay calm most often when driving, but I could imagine someone who spooks easily could have lost control of this car when it made weird noises and lit up a ‘transmission fault’ message on the dashboard, and possibly ended their life and lives of others.

    Mh car had two clutch packs replaced in 2018 and last summer (2019) the car started rolling backward on slight inclines in Drive. Problem? The transmission control module failed again.

    I sincerely hope the DoJ in the United States throws the book at Ford for knowingly committing fraud.

    My 2012 Focus has been the LEAST reliable car I have ever
    owned. I won’t ever consider buying another Ford product. The thing is that Ford Canada now gives two s**** about the safety issues with these cars also.

    I have paid Ford for not one but two fiestas. 2013 and 2015. The 2013 had the tranny go just after 1 1/2 years, the 2015 was a trade in and the tranny was going this last year. Because of Strathmore ford I was not told of the transmission problems and traded to the 2015. I paid ford Canada $33,000 and am now in for another $33,000 because I needed a vehicle asap for work. I feel like I was raped by ford and to top it all off they wouldn’t accept me for another loan and had to go to TD Bank. Is there anyway I can get help on this matter? I’m almost 60 years old and will be paying them into my retirement.

    I too am continually in shop and now being charged to look at the car and it too has been temporarily fixed only to have the same thing happen again. What about the Great USA.

    I am a North Carolina resident and I am not able to apply to this class action? My 2015 Ford focus has had 3 clutches replaced in 4 yrs. It’s not fair that I am excluded because of the state I’m in….i have a class action regarding this problem! How can I be compensated regarding Ford’s faulty clutch?
