National Holdings Corporation has agreed to pay $325,000 to resolve claims that they violated federal law by calling consumers on the Do Not Call Registry.

The settlement will benefit all individuals who received one or more telemarketing call from a National Securities representative within a 12 month period between Nov. 11, 2010 and May 24, 2019 despite having registered their number on the National Do Not Call Registry.

Plaintiff Philip Charvat filed a class action lawsuit against National Holdings and Shampan Lamport in November 2014 and February 2016, respectively. These two class action lawsuits were consolidated in November 2017.

Charvat claimed that Shampan Lamport made telemarketing calls on behalf of National Holdings in order to solicit the company’s services and products. The consolidated class action alleged that the calls were made to individuals even if they had registered their number on the National Do Not Call Registry, meaning that the companies violated the Telephone Consumer Protection Act.

The Telephone Consumer Protection Act (TCPA) is a federal law designed to protect consumers from harassing telemarketing communications through calls, texts, and faxes. Under the TCPA, businesses are not allowed to call individuals if they have registered their number on the National Do Not Call Registry.

The recently reached TCPA settlement will provide each affected Class Member with a payment estimated to be $20. Depending on the number of valid claims filed, the actual payment amount could be higher or lower than this estimate.

Class Members have until Aug. 23, 2019 to file a valid claim. The deadline for exclusion and objection is also Aug. 23, 2019. The final approval hearing is scheduled for Sept. 25, 2019.

Who’s Eligible

Individuals who received one or more telemarketing call from a National Securities representative within a 12 month period between Nov. 11, 2010 and May 24, 2019 despite having registered their number on the National Do Not Call Registry.

Potential Award

An estimated cash payment of $20. The actual payment amount could be higher or lower depending on the number of valid claims filed by Class Members.
