North American Bancard customers have secured a $15 million settlement ending class action claims that the credit card processing company overcharged merchants with unauthorized fees.
Class Members include merchants who used Global Payments Direct and received merchant services from North American Bancard (NAB) between Aug. 31, 2009 and March 31, 2019.
Lead plaintiffs accused Global and NAB of charging excessive fees from merchants and failing to obtain proper authorization to assess those fees.
Merchants generally must pay a fee in order to accept debit and credit cards at their place of business. These fees usually consist of a percentage of the transaction as well as a fee for each transaction.
The practice of charging and assessing fees is complicated, and Global and NAB took advantage of this confusion to slam small and middle sized merchants with excessive fees, alleged the plaintiffs.
According to the class action lawsuit, Global and NAB promised smaller merchants that they would make the payment process simple and straightforward by using standard contracts. Instead, these smaller merchants were allegedly hit with unexpected markups and mystery fees.
The Bancard, Global Payments payment fee class action lawsuit accused the companies of violating contracts with these smaller merchants over the course of several years in order to generate more revenue.
The companies deny any wrongdoing, but have agreed to pay affected merchants under the terms of a settlement in order to end the class action lawsuit. In addition, the companies have agreed to change their policies regarding the calculation and assessment of fees.
Class Members include current and former customers of Bancard, also known as NAB, and Global Payments.
Current customers, including Class Members who received payment processing services through Global and Bancard as of March 31, 2019, will automatically receive a cash credit on future invoices if they still contract with the companies.
Those who have ended their contract with Global and Bancard can receive an electronic or cash payment.
Former customers, including Class Members who ended their contract with Global and Bancard prior to March 31, 2019, will need to file a claim in order to receive payment.
Payments will be based on the transactions that were processed through Global and Bancard for each Class Member and the number of valid claims that are submitted.
The deadline to object to or opt out of the Bancard, Global Payments payment fee class action settlement is July 16, 2019.
Who’s Eligible
Class Members include “merchants who contracted with or through Global and received merchant services from NAB at any time from August 31, 2009 through March 31, 2019 or who were referred by NAB to Global during that period.”
Potential Award
Varies.
“Your payment under the Settlement depends on the amount of your alleged overcharges. Some Class Members were charged tens of thousands of dollars in challenged fees while other Class Members’ alleged overcharges were quite small. The amount of your alleged overcharges was calculated based on such factors as the specific charges that you were assessed, the type of transactions in which you engaged, the length of time you were an NAB customer, and your sales volume.”
Class Members can email the settlement administrator to find out their estimated credit or cash payment at administrator@NABsettlement.com.
Proof of Purchase
Former customer Class Members will need to submit a Claim Form with their business address. Current customers do not need to file a Claim Form.

It seems small candy stores/bodegas here, in NY, are
charging debit card users 4% on each purchase if
they use their card.
