$257,500 in coupons are available to customers who purchased certain discounted items from Murphy Oil stores, resolving sales tax class action lawsuit claims.
The recent settlement will benefit consumers who purchased a discounted or sale price item at a Murphy USA or Murphy Express store on or after Jan. 8, 2016.
The coupon settlement was reached to resolve claims that Murphy Oil fraudulently calculates sales tax based on regular prices, even if an item is discounted.
The Murphy Oil class action lawsuit argues that the gas station “unfairly and deceptively” charged excess sales tax to their customers despite laws on the matter.
Plaintiff Steven Holt filed his class action lawsuit against Murphy Oil after allegedly being charged excessive sales tax in Alabama.
Despite purchasing two Kit Kat bars for the discounted price of 2 for $2, Holt was allegedly charged sales tax based on the bars’ regular price of $2.78.
Holt argued that his experience mirrored that of customers from around the country. The unlawful practices allegedly occurred in 24 states, including: Alabama, Arizona, Colorado, Florida, Georgia, Iowa, Illinois, Indiana, Kansas, Kentucky, Louisiana, Michigan, Minnesota, Mississippi, North Carolina, Nebraska, New Mexico, Nevada, Ohio, Oklahoma, South Carolina, Tennessee, Utah, and Virginia.
To resolve these claims, Holt and Murphy Oil agreed to a settlement that would provide 257,500 $1 coupons to affected customers. In April 2019, a website was established for the settlement Class Members.
To benefit from the settlement, customers simply need to register their email on the website. Murphy Oil customers have until Sept. 17, 2020 to register their email and receive a coupon.
The deadline for exclusion and objection is Aug. 16, 2019. The final approval hearing is scheduled for Sept. 17, 2019.
Who’s Eligible
Consumers who purchased a discounted or sale price item at a Murphy USA or Murphy Express (excluding Missouri and Texas) store on or after Jan. 8, 2016.
