Details: The Helio Early Termination Fee (ETF) class action lawsuit alleges that it’s unlawful for Helio to charge a flat-rate $175 service fee to consumers who end their wireless contract before the expiration date. If you were charged an Early Termination Fee by Helio or you continued to maintain service with Helio because of an Early Termination Fee prior to October 4, 2010, you may be entitled to a cash refund from a class action lawsuit settlement.

Under the Helio ETF class action lawsuit settlement, Helio has agreed to provide a cash refund to all class members who submit a claim form. You’re considered a member of the class if you are a current or former Helio customer who, at any time prior to October 4, 2010, had a contract with Helio for wireless telephone service that contained an Early Termination Fee. You have two options file a claim for a cash refund under the class action settlement:

Helio ETF Settlement Refund Option #1: If you paid the flat-rate Early Termination Fee to Helio and have a record of this payment, you’ll be entitled to a refund of $5 per every month that was left in the contract minus any amounts owed to Helio for wireless service. For example, if you terminated your Helio contract after six months of service and paid the termination fee, you would be entitled to $25, less any amount owed to Helio for wireless service.

Helio ETF Settlement Refund Option #2: If you did not pay the termination fee or cannot prove that you paid the fee, or were not charged an Early Termination Fee but verify under oath that you did not terminate your Helio contract prior to expiration because you didn’t want to be charged the Early Termination Fee, you are entitled to a $10 refund.

In addition to the cash refunds, Helio must also pro-rate Early Termination Fees for a period of two years as part of the class action lawsuit settlement. More details the terms of the settlement agreement can be found at www.TerminationFeesSettlement.com.

To claim your cash refund from the Helio ETF settlement, you must submit a valid claim form either online or postmarked by January 14, 2011. The Fairness Hearing is scheduled for December 15, 2010.
