A $37.8 million settlement has been reached resolving claims that C.R. England Inc. and Opportunity Leasing Inc. duped truck drivers into entering into a “Driving Opportunity” in violation of Utah and Indiana state laws.
Class Members include truck drivers who entered into a vehicle lease agreement with Opportunity Leasing Inc., also known as Horizon Truck Sales and Leasing, and an independent contractor operator agreement with C.R. England Inc. between May 27, 2007 and Jan. 31, 2017.
According to the C.R. England class action lawsuit, the “Vehicle Lease Agreement” touted the opportunity to work with C.R. England’s major clients, including Walmart, but those who signed up for the program could not earn any money under its terms.
The plaintiffs alleged that the “Driver Opportunity” was marketed as a guaranteed job by C.R. England and Horizon. The trucking companies offered to pay for trucking school, then drivers would have to pay back the money at 18 percent interest using their earnings.
In reality, contended the C.R. England class action lawsuit, drivers were never able to repay their school tuition, and C.R. England used the program to force drivers to pay for the costs of transporting items to clients.
In addition, when drivers attempted to end their relationship with the trucking company, it or its affiliates allegedly went after them for the school tuition.
C.R. England agreed to pay $37.8 million to end the class action lawsuit. In addition, the trucking company has agreed to cancel remaining debt for Class Members related to the Driving Opportunity program costs and related licenses and other fees.
Under the terms of the settlement agreement, all Class Members will receive a minimum of $1,000. Class Members may be entitled to additional payment based on when they signed the Vehicle Lease Agreement of approximately $500. Class Members will be automatically enrolled in the settlement and will receive payment should the court grant final approval.
A toll free settlement hotline has been set up for Class Members with questions about their payment and/or cancellation of debt. The number is 1-877-242-2522.
