Seventh Veil dancer class action settlement

California exotic dancers have secured a $1.6 million settlement resolving claims that Seventh Veil, Royal Palace, and Crazy Girls dancers were misclassified as independent contractors instead of employees.

Class Members include dancers who signed independent contracting agreements with 7180 Sunset Blvd. Inc., and/or Three Group Inc. to perform at either Seventh Veil and/or Royal Palace between March 23, 2013 and Jan. 1, 2017, and/or Crazy Girls between March 23, 2013 and Jan. 31, 2019.

A former dancer lodged the Seventh Veil, Royal Palace dancer wages class action lawsuit after she says she was unfairly classified as an independent contractor and not an employee.

The worker accused the gentleman’s clubs of misclassifying dancers in order to afford them fewer rights than they were due under California employment law. In addition, dancers were forced to pay “state” or “house” fees in order to work, according to the lawsuit.

Under California wage and hour law, employees are entitled to minimum wage, overtime and meal and rest breaks. However, 7180 Sunset and Three Group allegedly forced workers to sign an agreement indicating they were independent contractors and not employees. Then, alleged the plaintiff, dancers were not paid for overtime work and denied meal and rest breaks.

Workers who are classified as independent contractors should have more freedom in when and how to do their jobs, although they forgo many rights and protections that employees have under California law.

The Seventh Veil, Royal Palace dancer wages class action lawsuit claimed that the plaintiff and other Class Members’ employers were attempting to deny these employment law protections, but the requirements of the work should have meant that the dancers were considered employees.

7180 Sunset and Third Group admit no liability, but have agreed to pay Class Members an award in order to settle the Seventh Veil, Royal Palace dancer wages class action lawsuit.

In addition, the companies have agreed to come into compliance with California wage and hour law and start classifying dancers as employees.

Each award will depend on the number of valid claims submitted, but is estimated to be $868. Class Members will be automatically opted into the Seventh Veil, Royal Palace dancer wages class action settlement.

Class Members must have a valid Social Security number and, if a W-9 form is included in the Class Member’s Notice, the form will need to be returned to obtain a payment. Class Members who do not receive a settlement Notice should contact the settlement administrator at (855) 309-1484.

Dancers who wish to object to or opt out of the Seventh Veil, Royal Palace dancer wages class action settlement need to do so by June 5, 2019.

Who’s Eligible

Class Members include “all individuals who signed an independent contractor agreement and a) performed at the Seventh Veil and/or Royal Palace (also known as Star Strip) night clubs during the period March 23, 2013 to January 1, 2017; and/or b) performed at the Crazy Girls night club during the period March 23, 2013 through January 31, 2019.”
