A $1.45 million class action settlement will benefit consumers who received advertising text messages from InstantCarOffer.com.

Under the terms of the settlement, Class Members include those who put an ad on the popular resale website Craigslist.com and then received unwanted texts on their cell phone from InstantCarOffer.com between Sept. 4, 2011 and July 12, 2017.

Defendants American Motor Company and Off Lease Only Inc. allegedly sent consumers unwanted texts touting their website, InstantCarOffer.com, to purchase used cars that the consumers had posted on Craigslist.com.

The InstantCarOffer.com class action lawsuit claimed that the companies used software to “scrape” their phone numbers from the resale site in order to send the unwanted texts.

American Motor Company contracts with dealerships nationwide to facilitate the sale of used cars. One of those dealerships is reportedly Off Lease Only.

According to the InstantCarOffer.com text message class action lawsuit, the companies used cell phone numbers that they scraped from Craigslist to send the unsolicited messages. The plaintiffs accused the companies of violating the Telephone Consumer Protection Act.

The Telephone Consumer Protection Act, or TCPA, sticks companies with steep fines if they are found to be in violation of its prohibitions on telemarketing. Under the federal law, consumers are protected from unwanted or unsolicited text messages.

The plaintiffs accused the companies of failing to obtain permission before sending them and other consumers text messages touting InstantCarOffer.com.

American Motor Company and Off Lease Only agreed to pay slightly more than $1.45 million to end the InstantCarOffer.com text message class action lawsuit.

Under the terms of the settlement, Class Members are expected to receive up to $50. To make a claim, Class Members must either submit the Class Member ID provided on their Notice or the phone number that received the unwanted InstantCarOffer.com text.

The deadline for Class Members to object to or opt out of the InstantCarOffer.com text message class action settlement is May 21, 2019.

Who’s Eligible

Class Members include “all subscribers within the United States (i) who received a text message (ii) on his or her cellular telephone (iii) from InstantCarOffer.com, on behalf of Off Lease Only, Inc., (iv) through the use of the Twilio platform (v) after placing an advertisement on craigslist.org in connection with the sale of a vehicle (vi) from September 4, 2011 to July 12, 2017.”

Potential Award

Up to $50.

Proof of Purchase

Class Member ID or cell phone number that received the text message.

    I received several 100 unsolicited insurance quote phone calls over a month or two time. I would tell them I wasn’t interested and I would get other call from the same number over and over again. Why isn’t this instance not breaking any laws? No joke Over a 4 month period I probably received over 750 calls. I would also tell them to stop calling this number and take me off any lists they had my number on.
