AMN traveling nurse working at hospital

A $20 million settlement has been reached to resolve claims that AMN traveling nurses in California were denied overtime wages and breaks.

The settlement will benefit individuals who worked for AMN as a traveling nurse at one or more Kaiser facilities in California between Sept. 11, 2013 to Dec. 27, 2018.

According to the class action lawsuit that lead to the $20 million settlement, traveling nurses employed by AMN Services LLC were denied sufficient pay and rest periods while assigned to Kaiser facilities in California.

The traveling nurses were reportedly denied overtime pay and were not allowed legally compliant meal and rest periods, which violates California labor laws.

Due to these alleged labor law violations, the travel nurse plaintiffs brought claims for unpaid wages, failure to provide meal and rest periods, inaccurate wage statements, failure to maintain pay records, failure to pay final wages, unfair competition and civil penalties under the Private Attorneys General Act (PAGA).

PAGA is a California state law that allows employees to file lawsuits on the behalf of the state for labor code violations. When these lawsuits reach a settlement or verdict, a portion of that amount is paid to the State of California.

There is no Claim Form required to participate in the AMN settlement. The amount each Class Member can recover will depend on the number of workweeks worked at a Kaiser facility as an AMN travel nurse.

The deadline to object to the settlement or be excluded is April 11, 2019. The final approval hearing is scheduled for May 31, 2019.

Who’s Eligible

Individuals who worked for AMN as a traveling nurse at one or more Kaiser facilities in California between Sept. 11, 2013 and Dec. 27, 2018.

Potential Award

Varies depending on the number of workweeks worked at a Kaiser facility between Sept. 11, 2013 and Dec. 27, 2018.

The settlement fund will be divided by the total number of workweeks claimed by all Class Members during the Class period. This value will be used to determine the payout per workweek. Each individual settlement payment will be the value of the workweek multiplied by the number of workweeks worked.

    I’m filing another labor complaint Monday morning for exact same thing if they don’t pay me over $8000 unpaid wages. And for wage reclassification.

    I worked in San Leandro ,And they still owe me 250.00 from the strike. They said since I worked Saturday after the strike ended they would just average the money and not pay the strike pay.. Still waiting!!!
