Mesa Laboratories Junk Fax Class Action Settlement

A $3.3 million class action settlement has been reached to resolve claims that Mesa Laboratories violated federal law by sending out junk faxes.

If you were sent an unsolicited fax advertisement from Mesa Laboratories Inc. between Feb. 1, 2014 and Dec. 7, 2018, you could get cash from this class action settlement.

Plaintiff James L. Orrington II, DDS, filed the class action lawsuit against Mesa Laboratories after allegedly receiving unsolicited fax advertisements from the company without opt-out details.

Dr. Orrington claimed that he and other consumers were harmed by these actions because their ink, toner, and paper was wasted, their fax equipment was interfered with, and their right to privacy was invaded.

In his class action lawsuit against Mesa Laboratories, Dr. Orrington argued that the unsolicited fax advertisements were a violation of the Telephone Consumer Protection Act (TCPA).

The TCPA is a federal law that aims to protect consumers from harassing communications through calls, text messages, and faxes. Companies that implement these communications without consent from the consumer may be in violation of the TCPA, entitling consumers to compensation.

It was revealed during discovery that as many as 42,000 fax numbers were sent advertisements from Mesa Laboratories.

The settlement to resolve Orrington’s TCPA claims was initially approved in January 2019. Mesa Laboratories does not admit any wrongdoing by settling the claims against them. Instead, the settlement allows both parties to reach a resolution while avoiding the costs and risks associated with continuing the litigation.

Class Members who submit a valid claim by April 15, 2019 may be able to collect payment from the settlement.

The amount each claimant can recover will depend on the number of claims filed and the amount of the settlement fund left over after payment of attorneys’ fees, court costs, and incentive awards.

The date to be excluded or to object to the settlement is April 15, 2019. The final approval hearing has been scheduled for May 24, 2019.

Who’s Eligible

All individuals who were sent unsolicited fax advertising from Mesa Laboratories Inc. between Feb. 1, 2014 and Dec. 7, 2018.

Potential Award

Payment amounts will depend on the number of valid claims filed. Class Members will receive an equal share of the settlement fund once litigation costs have been paid.

“The value of each individual settlement payment cannot be determined until the Claims Deadline has passed, all claims have been verified, and any appeals have been resolved,” the class action settlement website states.
