Parents have solidified a $2.4 million settlement agreement in a long-running class action lawsuit resolving claims that Aveeno Baby Calming Comfort Bath and Aveeno Baby Wash and Shampoo are deceptively marketed as being “natural.”
If you purchased Aveeno Baby Calming Comfort Bath or Aveeno Baby Wash and Shampoo in Alaska, Arkansas, California, Connecticut, Delaware, the District of Columbia, Florida, Hawaii, Illinois, Massachusetts, Michigan, Missouri, New Jersey, New York, Rhode Island, Vermont, Washington or Wisconsin on certain dates ranging from 2007 through 2013, you could get cash from this settlement.
Lead plaintiffs accused Johnson & Johnson of falsely advertising its baby wash and shampoo products up until 2013, when the company changed its promotional material.
The Aveeno class action lawsuit alleged that the two products were marketed as made from “100% naturally sourced ingredients,” but actually contained synthetic ingredients and were only one percent natural.
According to the Aveeno natural baby wash class action lawsuit, the products were touted as being made with a “natural oat formula.”
“Since oats are obviously natural, the phrase ‘Natural Oat Formula’ constitutes a representation to a reasonable consumer that the entire formula is comprised of natural ingredients,” the Aveeno baby class action lawsuit states.
However, 23 synthetic ingredients were reportedly found in the washes, and the plaintiff contends that she and other consumers would not have paid so much for the baby products had they known.
Aveeno agreed to settle the natural baby wash class action lawsuit after the Class was certified.
Under the terms of the settlement, Class Members can receive $1 for each Aveeno baby wash product they purchased for household use.
Class Members include those who purchased either Aveeno Baby Calming Comfort Bath or Aveeno Baby Wash and Shampoo in certain states during certain time periods. A list of the states and time periods can be found under the Who’s Eligible section below.
No proof of purchase is required for up to 15 products. Consumers who want to claim more than 15 products will need to provide a receipt along with their Claim Form.
