A $3.1 million settlement has been reached in a class action lawsuit filed over a 2014 Community Health Systems data breach.
If your personal information was exposed during the 2014 data breach that affected the computer network system at Community Health Systems, you could get up to $5,250 from this class action settlement.
Lead plaintiffs accused Community Health Systems Professional Services Corporation (CHSPSC) of failing to properly protect the personal information of patients in their computer system.
The personal information compromised in the Community Health Systems data breach included names, addresses, birthdates, Social Security numbers, phone numbers, and potentially even employers, according to the class action lawsuit.
A number of class action lawsuits were filed after the breach was disclosed by CHSPSC on Aug. 18, 2014. The complaints were consolidated into multidistrict litigation over the Community Health Systems data breach.
The Community Health Systems data breach class action lawsuit accused the vast healthcare network of failing to update its systems to protect the sensitive personal information they held.
Further, plaintiffs say CHSPSC failed to promptly notify those affected by the Community Health Systems data breach, exposing Class Members to identity theft and fraud.
CHSPSC agreed to pay $3.1 million settle the class action lawsuit. Under the terms of the settlement Class Members may be able to make out-of-pocket claims from the breach as well as for any expenses related to fraudulent charges stemming from the Community Health Systems data breach.
Class Members can make a claim for both Response Expense Reimbursement and Fraud Loss Reimbursement.
Response Expense Reimbursement claims can include up to $250 to cover the costs of any financial monitoring services, lost time spent dealing with the data breach, costs of credit reports, and other incidental expenses.
Fraud Loss Reimbursement claims can include any out-of-pocket losses from fraud or identity theft stemming from the Community Health Systems data breach up to $5,000. Class Members must provide documentation of the losses suffered.
Those Class Members who want to object to the settlement or wish to be excluded from it, must do so in writing by May 18, 2019.
Who’s Eligible
Class Members include those whose personal information was exposed in the 2014 Community Health Systems data breach.
“The Settlement defines ‘Personal Information’ as information that is or could be used, whether on its own or in combination with other information, to identify, locate or contact a person, including without limitation names, addresses, birthdates, social security numbers, telephone numbers, and the names of employers and/or guarantors.”
Potential Award
$250 to $5,250 depending on the Class Member’s expenses and losses attributed to the Community Health Services data breach.
Up to $250 in reimbursement may be claimed for expenses related to cost of credit monitoring, time spent dealing with the data breach, cost of credit reports, payments for credit freezes, overdraft fees, phone calls, etc.
Up to $5,000 is available to Class Members who can provide documented monetary loss due to the security breach.
Class Members have the option of filing a claim for either or both of these payments.
Proof of Purchase
Class Members will need to provide proof of each claim, including proof of purchase of credit monitoring, time spent, and any other costs. Class Members making a claim for fraud will need to provide documentation of unreimbursed costs related to the breach.
