A $40 million DairyAmerica pricing settlement has been reached to resolve claims that the dairy company conspired to lower raw milk prices.

Class Members eligible for payment under the DairyAmerica pricing settlement include U.S. dairy farmers who sold raw milk priced according to a Federal Milk Marketing Order between Jan. 1, 2002 and April 30, 2007.

Valid claims need to be filed by Jan. 28, 2019 in order to be eligible for payment under the DairyAmerica pricing settlement.

The amount of compensation available for each Class Member will depend on a variety of factors, including: the amount of raw milk sold by each Class Member; the number of valid claims filed for the DairyAmerica pricing settlement; and the amount from the settlement fund needed for attorneys’ fees, court costs, and lead plaintiff service awards.

The milk price-fixing class action was first filed in 2009 and claimed that DairyAmerica Inc. and California Dairies Inc. conspired together to underreport sales data to the United States Department of Agriculture (USDA).

This allegedly resulted in the lowering of raw milk prices paid to dairy farmers, meaning that farmers were paid less than they were owed.

The Dairy America pricing settlement was proposed in August 2018 after almost 10 years of ongoing litigation.

Class Members who want to object or ask to be excluded from the milk pricing class action settlement must do so by Jan. 28, 2019.

Who’s Eligible

Dairy farmers who sold raw milk priced according to a Federal Milk Marketing Order between Jan. 1, 2002 and Apr. 30, 2007.

Potential Award

Varies. Will depend on the amount of raw Grade A milk produced, number of valid claims submitted, and the amount of the settlement fund needed for attorneys’ fees, court costs, and service awards.

    I just received an email that I have NOT opened! I’m apprehensive because from what I can see, it’s asking me to open the email and click on a link to ‘accept my payment’ for $7.51. Then if I don’t, basically I don’t get anything. I’ve been in a few class actions and have NEVER been asked to do something like this. Needless to say, with all the scams happening, I’m apprehensive about this. And this is Sunday! Another red flag. What attorney offices work on Sunday? If anyone has information, please advise/update. My general rule is never give any personal information. Especially over a whopping $7.51!

      DFA needs to pay up & shut down. MarkI cant believe they let DFA buy Dean Foods. Corporate is gonna do the same thing to the beef market that DFA did to the milk market.
