Consumers who received an unsolicited phone call from Compass Bank may be entitled to a part of a $5.86 million settlement that ended a class action lawsuit alleging the financial institution violated the Telephone Consumer Protection Act (TCPA).
Several non-Compass Bank customers claimed in a class action lawsuit that they and others received automated debt collection calls from the bank even though they had not agreed to receive those calls.
The Compass Bank class action lawsuit further alleged the company used an automatic dialing system to call Class Members’ cell phones, using up valuable minutes and data, as well as consumers’ time.
The plaintiffs argue that Compass Bank’s unsolicited phone calls violated the TCPA. The TCPA is a federal law that protects consumers from annoying telemarketing calls. Enacted by Congress in 1991, the law prohibits telemarketing calls without the prior consent of the person being called. It also restricts companies from using prerecorded messages and automatic dialing systems.
“In an attempt to reduce costs associated with maintaining its automated calling operation, BBVA [Compass] spurns procedures necessary to confirm that the telephone numbers to which BBVA places robocalls actually belong to the customers who have supposedly provided them to Defendant,” the BBVA Compass class action lawsuit states.
The Compass Bank class action lawsuit further states that these phone calls were made by a predictive dialer and when the plaintiffs answered the call, they were greeted with a prerecorded voice message.
Under the terms of the class action settlement, Compass Bank will pay $5.86 million to end the litigation. In addition, it has agreed to change its calling procedures going forward.
Class Members include consumers nationwide who were not members of Compass Bank or who provided permission for the bank to call them, but received a call between June 21, 2014 and Aug. 24, 2018. Class Members have until Jan. 21, 2019 to submit a claim.
The period for Class Members to object to or exclude themselves from the class action settlement passed on Oct. 23, 2018. The final hearing was held Dec. 6, 2018.
Who’s Eligible
Class Members include consumers nationwide who received a call from Compass Bank to their cell phones between June 21, 2014 and Aug. 24, 2018. Class Members must not have been Compass Bank customers or otherwise agreed to receive calls from the bank.

$339
The Compass Bank class action settlement states that in the event that the $5.86 million is not enough to give everyone who submits a valid claim $339, the amount paid will be adjusted downward on a pro rata basis.
