Former Charlotte School of Law students may be able to get cash from a $2.65 million class action settlement over allegations that the institution did not comply with accreditation standards.
The multimillion-dollar settlement resolves claims Charlotte School of Law both flouted American Bar Association (ABA) accreditation standards and failed to tell current and prospective students that its ability to function was compromised as a result.
Charlotte School of Law — part of a group of three for-profit law schools — was allegedly under investigation by the Department of Education over its failure to comply with ABA standards.
As a result, the school lost its ability to accept student loans from the federal government, including Federal Work-Study, Federal Perkins Loans, and Federal Direct Loan programs, which include the Federal Direct Unsubsidized Stafford/Ford Loan program and the Federal Direct PLUS Program.
The lead plaintiffs in the class action lawsuit alleged that Charlotte School of Law officials were well aware of the situation since at least 2016, but failed to take action to regain its accreditation.
Charlotte School of Law, or what remains of the now shuttered school, has agreed to pay $2.65 million to end the class action lawsuit brought by former students who alleged they paid more than $40,000 per year for a useless degree from an unaccredited institution.
Though the students noted in their motion for approval of the proposed settlement that the amount would not come close to reimbursing Class Members, it was the best they could do in the face of pending bankruptcy proceedings sure to decimate the remaining assets of Charlotte School of Law.
The settlement amount may increase if either Florida Coastal School of Law, Arizona Summit School of Law, or both are sold by April 20, 2019.
Additionally, should any of three lawsuits brought by Charlotte School of Law against the ABA be resolved in favor of the school, the verdict will be added to the settlement award for this class action lawsuit.
Class Members include those enrolled in or who paid fees to Charlotte School of Law from Sept. 1, 2013, through Aug. 15, 2017 — most should have received a postcard notifying them of the class action settlement.
The deadline to make a claim was Dec. 11, 2018.
Class Members who wish to exclude themselves or object to the class action settlement must have done so by Nov. 26, 2018. The final hearing took place Jan. 9, 2019.
Who’s Eligible
Class Members include those who “were enrolled in, attended, or paid tuition or fees to CSL between September 1, 2013 through and including and August 15, 2017.”
Potential Award
Varies. Claim amounts are dependent on each Class Members “Category” and “Tier” as determined by whether students were enrolled and if they obtained a degree from Charlotte School of Law. A chart is available on the notice.
