If you made a qualifying promotional purchase at a Massachusetts Sleepy’s location, you may be eligible to recover $25 or $110 from a class action settlement fund.

Plaintiff Dianna Khun filed the class action lawsuit in November 2016 alleging that Sleepy’s LLC made misleading statements to deceive their customers.

Khun says the company offered promotional gift cards on qualifying purchases but severely limited the redemption and use of the gift cards. The Sleepy’s class action lawsuit states that these actions were in violation of Massachusetts and federal consumer protection laws.

Consumers are eligible for the Sleepy’s class action settlement if they made a qualifying promotional purchase at a Sleepy’s retail location in Massachusetts or for a Massachusetts delivery between Nov. 7, 2012 and July 23, 2018.

There are two settlement subclasses: the redeemed voucher subclass and the unredeemed voucher subclass.

The redeemed voucher subclass includes consumers who redeemed the voucher which was provided as part of their qualifying promotional purchase and the unredeemed voucher subclass did not.

No Claim Form is required to take part in the Sleepy’s voucher class action settlement, but Class Members have until Oct. 4, 2018 to object or be excluded from the settlement. The final hearing is set for Nov. 27, 2018.

In addition to compensating consumers, the settlement fund with provide compensation for class counsel and an award for the Class Representative.

Class counsel plans to apply for less than $250,000 to cover their legal fees and court costs. As the Class Representative, Khun will receive a service award of $6,300.

Who’s Eligible

Consumers who made qualifying promotional purchase at a Sleepy’s retail location in Massachusetts, or an online purchase for a Massachusetts delivery, between Nov. 7, 2012 and July 23, 2018.

Potential Award

If you redeemed your voucher(s), you are entitled to $25 for each voucher you were entitled and redeemed. If you did not redeem your voucher(s), you are entitled to the actual value of the voucher which averages at $110.33.
