If you purchased a Cricket cell phone between July 12, 2013 and July 9, 2018, you may be eligible for numerous benefits available in a class action settlement.

Following Cricket’s merger with AT&T, numerous consumers found that they were unable to use their Cricket Code Division Multiple Access (CDMA) phones. This prompted lead plaintiff Tim Bond to file a class action lawsuit against Cricket Communications LLC in March 2015. After years of litigation, the two parties have reached a settlement.

Class Members include consumers who have purchased a qualifying Cricket CDMA phone between July 12, 2013 and July 9, 2018.

Under the settlement, Class Members are eligible for one of three benefits:

  1. Unlock Benefit: Settlement Class Members will be able to unlock their qualifying CDMA phone which may allow them to activate the phone with another wireless carrier.
  2. Data Benefit: Settlement Class Members will be able to port an existing wireless number onto a new line of Cricket service without paying an activation fee, and receive an additional 1 GB of high speed data for free after maintaining one month of service.
  3. Four Month Data Benefit: Settlement Class Members who maintain one month of future Cricket service on either an existing or new line of Cricket service will be able to receive 1 GB of free high speed data for up to four subsequent consecutive months of timely prepaid service.

Claim Forms can be submitted online or through the mail, but must be submitted by Feb. 4, 2019.

Class counsel will ask for attorneys’ fees and expenses up to $300,000. Bond will potentially receive a service award payment of $3,500.

Class Members who want to object or opt out of the Cricket class action settlement must do so by Oct. 9, 2018.

A final approval hearing is scheduled for Nov. 16, 2018.
