A $650,000 settlement has been reached in a class action lawsuit alleging McIlhenny Company represented its Tabasco brand products as being “Made in the U.S.A.” when portions of the product were allegedly foreign sourced.
McIlhenny denies any wrongdoing, but both sides have agreed to resolve the Tabasco class action lawsuit to avoid the uncertainty and cost of further litigation and provide benefits to consumers.
If you purchased McIlhenny Company Tabasco®-brand products in California between September 15, 2011 and March 19, 2018, you may be entitled to compensation from the Tabasco class action settlement.
Plaintiff Iraj Dowlatshahi filed the Tabasco class action lawsuit on March 24, 2017, claiming McIlhenny violated California law by inaccurately representing the country of origin of its Tabasco brand products.
The class action lawsuit asserts claims for violations of California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act.
Under the terms of the class action settlement, consumers who submit a valid Claim Form will receive a cash payment of $2.50 without the need to present a receipt.
Consumers who present a receipt or receipts will receive a cash payment equal to the amount of all the Tabasco products they purchased during the Class Period.
In addition to providing cash benefits to Class Members who submit timely and valid Claim Forms, McIlhenny has also agreed to remove the “Made in the U.S.A.” references from product packaging and advertising in the California retail market.
The Tabasco class action settlement was preliminarily approved on March 19, 2018.
Class Members who would like to opt out of or object to the Tabasco settlement must do so no later than June 18, 2018.
Who’s Eligible
Class Members of the Tabasco settlement include anyone who purchased in California any McIlhenny Company products (including pepper sauces, jellies, condiments and other products) between Sept. 15, 2011 and March 19, 2018.
Potential Award
Cash payment of $2.50 without proof of purchase or cash payment equal to the amount of all purchases of the McIlhenny Company products purchased during the class period with a receipt or receipts showing proof of purchase.
NOTE: The actual amount of payment to claimants may be reduced proportionally if the total amount of claims exceeds the amount available in the settlement fund.
Proof of Purchase
None required. However, claimants who do not submit proof of purchase can claim only $2.50 while claimants who provide proof of purchase may be entitled to a cash payment equal to all Tabasco products purchased during the Class Period.
