JPMorgan Chase Bank NA has agreed to pay $8.3 million to settle a class action lawsuit alleging it misclassified assistant bank managers as exempt from overtime when they should actually have been classified as non-exempt workers. The plaintiffs say this alleged misclassification of employees violated certain California labor laws.

If you were employed as an assistant branch manager for Chase in California between Feb. 25, 2011 and March 5, 2018, you may be entitled to benefits from the class action settlement.

Plaintiff Mitra Erami initially filed the JPMorgan Chase class action lawsuit on Feb. 25, 2015. Similar complaints were subsequently filed, which alleged JPMorgan’s arbitration agreements violated a section of the National Labor Relations Act.

In December 2016, the plaintiffs paid for an online survey of assistant bank managers to gauge their response to their activities and hours. The results allegedly showed that assistant bank managers work nearly nine hours of overtime each week and did not receive meal breaks about 60 percent of the time.

Further, the survey allegedly found that 95 percent of assistant bank managers reported that they spent most of their time engaged in non-exempt tasks.

According to the wage and hour class action lawsuit, JPMorgan misclassified Class Members as exempt from overtime under state and federal law and from the meal and rest break provisions required by California labor law.

The plaintiffs also assert that JPMorgan Chase violated certain California labor laws with regard to providing accurate and itemized wage statements.

JPMorgan denies any wrongdoing but agreed to settle the California wage and hour lawsuit to avoid the burden and expense of trial. The JPMorgan Chase class action settlement was preliminarily approved on March 5, 2018.

The deadline to opt out of or object to the JP Morgan Chase class action settlement is June 12, 2018.

Who’s Eligible

Class Members include anyone who worked for Chase as an exempt assistant bank manager at any time from Feb. 25, 2011 and March 5, 2018.

Potential Award

Varies, based on the number of weeks worked as a Chase Bank assistant branch manager compared with the total numbers of all workweeks worked by all Class Members who participate in the Chase Bank settlement.

Proof of Purchase

Claims must be filed online and claimants must provide their Claim ID, PIN and the last four digits of their Social Security number.
