unsolicted fax lawsuit

Dentis USA has agreed to pay close to $600,000 to settle a class action lawsuit alleging the company violated the Telephone Consumer Protection Act (TCPA) when it faxed advertisements to individuals and dentists’ offices without permission.

The plaintiffs alleged in their class action lawsuit that the faxes did not contain opt-out information required under the TCPA and that they and other Class Members did not provide consent or have a prior business relationship with Dentis either. The plaintiffs say the unwanted faxes were sent to Class Members starting Sept. 16, 2012.

Under the TCPA, companies are prohibited from faxing, as well as calling or texting consumers, including other businesses, without consent. Violation of the TCPA can result in steep fines, up to $1,500 for a willful violation.

The law was enacted by congress in 1991 to stop annoying telemarketers from contacting consumers without permission. In addition to unwanted faxes, robocalls, automated dialing, sending unsolicited text messages, and calling numbers on the “Do Not Call Registry” are also not permitted under the TCPA.

Dentis does not admit any liability under the terms of the settlement, but it has agreed to pay Class Members up to $50.

The deadline to opt out of the class action lawsuit settlement is April 27, 2018.

Who’s Eligible

Class Members include those who received an unsolicited fax from Dentis without required prior express permission or opt-out notice between Sept. 16, 2012 and Feb. 16, 2018.

Potential Award

$13.75 – $50

Proof of Purchase

Business or individual name that received the fax and the phone number which received the fax advertisement from the defendant.
