A settlement has been reached in a class action lawsuit alleging that a phishing attack on Seagate Technology LLC resulted in the disclosure of 2015 Form W-2 data of employees who worked for Seagate and other corporate affiliates during the 2015 calendar year.
If you are a current or former Seagate employee whose 2015 Form W-2 data was compromised in the Seagate data breach, you may be entitled to benefits from the data breach class action settlement.
On March 1, 2016, Seagate reportedly disclosed that it had been the victim of a phishing attack that resulted in the disclosure of 2015 Form W-2 data for employees of Seagate and other affiliates. A Seagate employee allegedly responded to a ‘phishing’ scam and forwarded the 2015 Form W-2 data for all employees of Seagate and its affiliates.
A group of plaintiffs filed the data breach class action lawsuit against Seagate in April 2016.
According to the Seagate data breach class action lawsuit, some Seagate employees were informed that fraudulent tax returns had been filed in their names. Some of these employees found out that the fraudulent tax returns were not only filed in the employee’s name, but were jointly filed on behalf of their spouse and included their spouse’s Social Security number.
Seagate reportedly informed current and former employees about the Seagate data breach and offered them two years of free credit protection through Experian ProtectMyID.
The plaintiffs allege that Seagate failed to adequately protect their personal information and that they were injured due to the Seagate data breach.
Seagate denies any wrongdoing but agreed to settle the data breach class action lawsuit to avoid the cost and uncertainty of continued litigation.
The Seagate data breach class action settlement was granted final approval on March 14, 2018.
Who’s Eligible
You are a Class Member of the Seagate data breach settlement if you fall into one of the following two categories:
- Employee Class: Includes current and former employees of Seagate or its affiliates and whose W-2 information was involved in the Seagate data breach.
- Third Party Class: If you jointly filed your federal income taxes for 2015 with a Class Member as a spouse, or if you were listed as a dependent on a Class Member’s federal income tax filings for 2015 and were 21 or older at the time, you qualify as a Third-Party Class Member.
Potential Award
The Seagate data breach class action settlement offers the following benefits:
- Coverage under an Experian identity theft protection plan (Class Members who enrolled in the original identity theft protection plan can elect to be covered for an additional two years)
- Reimbursement of economic costs of up to $3,500 per Class Member. NOTE: To qualify for this benefit, the economic losses must have been related to the Seagate data breach and not otherwise reimbursable by Experian or another third party.
Proof of Purchase
Third Party Class Members must provide supporting documentation to demonstrate they either jointly filed their 2015 taxes with an Employee Class Member or that they were listed as a dependent on the Employee Class Member’s tax forms and were 21 or older at the time.
Class Members who seek reimbursement of economic costs must provide documentation of the losses. Please review the Claim Form carefully and provide all of the requested information and documentation.
