Sports Warehouse has agreed to pay $3 million to settle a class action lawsuit accusing it of using fake former price comparisons to advertise its athletic products and apparel.

If you purchased merchandise from Sports Warehouse that was advertised with a price comparison between Jan. 17, 2013 and Oct. 23, 2017, you may be entitled to payment from the fake sale class action settlement.

According to the fake sale class action lawsuit, Sports Warehouse deceived consumers by using false price comparison advertising. The plaintiff alleges these fake sale advertisements violate California laws which prohibit the advertisement of goods as discounted from false former prices and prohibit misleading statements about the existence and the amount of the advertised price reductions.

The Sports Warehouse class action lawsuit asserts claims for violations of California’s False Advertising Law, Unfair Competition Law, Consumers Legal Remedies Act, breach of contract, breach of express warranty and unjust enrichment.

Sports Warehouse denies all allegations of wrongdoing but agreed to settle the fake sale class action lawsuit to avoid the burden and expense of ongoing litigation.

In addition to providing compensation to Class Members who file timely and valid claims, the fake sale class action settlement will require Sports Warehouse change its business practices and implement a compliance program. The company has reportedly stopped using price comparison advertisements to sell its products.

Class Members who would like to opt out of or object to the Sports Warehouse settlement must do so no later than May 21, 2018.

Who’s Eligible

Class Members of the Sports Warehouse settlement include anyone who purchased merchandise from Sports Warehouse that was advertised with a price comparison between Jan. 17, 2013 and Oct. 23, 2017. NOTE: To qualify for benefits from the Sports Warehouse class action settlement, you must have been a resident of California at the time of purchase.

Potential Award

Varies, depending on a number of factors. The amount of each Class Member’s cash payment will be determined based on the total number of qualifying purchases made during the Class Period in relation to the total number of purchases made by all claimants.

Proof of Purchase

Class Members must submit their claims online and provide the CPT ID and Passcode that was provided to them in the notice of the class action settlement.
