New York FDCPA debt collection letter

Class Members in a Palisades Collection class action settlement have been granted extra time to claim benefits from a $3.9 million settlement fund.

The settlement benefits persons who were sued in New York City Civil Court by Palisades Collection, in an attempt to collect outstanding AT&T Wireless debts. Palisades has agreed to stop attempting to collect the alleged debts, and Class Members from whom Palisades collected money on those debts can claim payment from the settlement.

Seven named plaintiffs in the Palisades Collection class action lawsuit claim Palisades Collection, its law firm Pressler & Pressler LLP, or Asta Funding Inc. engaged in a number of improper debt collection practices, violating federal and New York debt collection laws.

They accuse Palisades Collection of suing alleged debtors, even though they did not have evidence that the debtors owed the debt in question. They also claim Palisades Collection made false statements in court documents and failed to have a lawyer give their lawsuits a proper review before filing them.

Plaintiffs claim Palisades Collection failed to notify the defendants in many debt collection lawsuits that they were being sued, yet still told the court that they had given proper notification. These lawsuits resulted in judgments that the plaintiffs say were improperly won, yet Palisades Collection used these judgments to collect money from the defendants.

Palisades Collection and their related defendants maintain they did nothing wrong, and they admit no liability by entering into this settlement.

The $3.9 million settlement fund will mostly be used to make payments to Class Members from whom the defendants actually collected money. Class Members must submit a timely and valid Claim Form to get payment. Claim Forms must be printed and mailed.

The fund will also be used to pay a total of $19,000 to the named plaintiffs in recognition of their service as class representatives.

Palisades Collection agrees to stop collecting certain AT&T Wireless debts that have been litigated in New York City Civil Court. Class counsel will also attempt to get existing New York City Civil Court judgments vacated. Vacated judgments will no longer exist, and they won’t show up in court records or credit histories.

Class counsel will try to get these judgments vacated whether or not the Class Member submits a Claim Form. Any Class Member who does not want their judgments vacated must opt out of the settlement.

Class Members can object to the settlement or opt out by submitting a written request no later than April 3, 2018. (The original deadline of March 20, 2018 has been extended.) Class Members who opt out of the settlement won’t get settlement payments, they may be subject to further attempts at collecting any AT&T Wireless debts they may owe, and class counsel will not try to get any of their judgments vacated.

Who’s Eligible

According to the order granting preliminary settlement approval, the settlement Class covers “[a]ll individuals against whom actions to collect AT&T Consumer Debts were brought in New York City Civil Court by Pressler & Pressler, LLP, as counsel for Palisades Collection, LLC and/or Asta Funding, Inc., with the exception of individuals against whom Sold Judgments were entered.”

Potential Award

Individual payments will depend in part on how much money the defendants collected from the individual Class Member and the number of valid and timely claims received. A copy of the allocation plan can be found here.

Proof of Purchase

No proof of purchase or other documentation is requested, other than the information requested on the Claim Form. The form asks claimants to submit their Social Security number. Claimants who prefer not to submit their Social Security number can contact the settlement administrator to make other arrangements.

    Not even sure what year this happened in. Maybe 2000. But I had a Sears credit card and I paid it off and closed it out. Yrs later in 2016 I got letters from those crooks saying I owed them and Sears $1300. To this day they never sent proof that I owed Sears anything. This happened in nj. In the end I borrowed the money to pay them off before they took my car. DMV had sent a letter telling me to hand over my title but I never did.

    I’m not sure if I’m eligible but I feel obligated to post this. In 2009 pressler and Pressler contacted me about a collection for AT&T for 708.00 dollars and I advised them that another collection agency had the same account that I was paying but I made payment arrangements anyway to avoid a negative on my credit report until I
    try to resolve the matter. In a few days time I received a letter from the New Jersey court that a judgement was filed for collection, a few days earlier I went to my bank to ask why my account was negative and they told me that Pressler and Pressler withdrew all my available funds and they did it before they filed the judgement, I had experian credit reporting agency to investigate and they confirmed exactly what they did, I still have all the paper work, so if anyone is being duped by this company file a class action suit against them, it’s to late for me I think statue limitations permit me to do so, if not I will start one.
    Don’t be fooled they are crooks of the worst kind.
