Tallahassee Dodge Chrysler Jeep LLC has agreed to pay $850,000 to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act (TCPA) by sending text messages to mobile phones without prior consent.

If you were sent a text message from Tallahassee Dodge Chrysler Jeep, you may be entitled to a cash payment from the TCPA class action settlement.

The Telephone Consumer Protection Act prohibits companies from contacting consumers via phone, text message, or fax for advertising purposes without their prior express written consent. The federal law also restricts the use of automated telephone equipment such as automatic dialing systems and artificial or prerecorded voice messages.

The proposed Tallahassee Dodge Chrysler Jeep settlement will resolve a TCPA class action lawsuit alleging the dealership sent Class Members automated telemarketing text messages, without their prior express written consent, and with little regard for their privacy.

According to the class action lawsuit, plaintiff Seth Masson received a text message from the dealership using a “spoofed” number in July 2017. The plaintiff says that the message was clearly automated and he and other Class Members did not agree to receive advertising from Tallahassee Dodge.

“Defendant’s unsolicited text messages caused Plaintiff actual harm, including invasion of his privacy, aggravation, annoyance, intrusion on seclusion, trespass, and conversion. Defendant’s text messages also inconvenienced Plaintiff and caused disruption to his daily life,” the class action lawsuit states.

Tallahassee Dodge denies the allegations but agreed to settle the TCPA class action lawsuit to avoid the burden and expense of ongoing litigation.

Class Members who wish to opt out of or object to the Tallahassee Dodge TCPA class action settlement must do so no later than April 6, 2018.

Who’s Eligible

The settlement includes all persons in the United States who received one or more text messages sent by or on behalf of Tallahassee Dodge Chrysler Jeep between July 27, 2017 and July 31, 2017.

Potential Award

Cash payments will be distributed on a pro rata basis to settlement Class Members depending on the number of valid Claims filed.

Proof of Purchase

Class Members must provide the cell phone number at which they received text messages from Tallahassee Dodge that allegedly violated the TCPA or a Claim Form identification number from the notice they received.
