Tribe App Inc., a video messaging application, has agreed to pay $200,000 to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act (TCPA) by sending text messages to wireless phone numbers without the recipients’ prior express written consent.
If you were sent a text message from Tribe App, you may be entitled to a cash payment from the TCPA class action settlement.
The Telephone Consumer Protection Act is a federal law that restricts telephone solicitations, text message spam and the use of fax machines for advertising and certain other purposes. The TCPA also prohibits the use of certain types of automated telephone equipment such as automatic dialing systems and artificial or prerecorded voice messages.
The proposed Tribe App settlement will resolve two TCPA class action lawsuits: Alexander M. Rattner v. Tribe App Inc. and Kenneth Horsley v. Tribe App Inc.
“To promote its mobile application, Defendant engages in deceptive and intrusive telemarketing,” plaintiff Rattner alleged in his Tribe App class action lawsuit. “Specifically, Defendant tricks users of its mobile application into granting access to their contacts lists.”
“Once in possession of users’ contact numbers, Defendant, using an automatic telephone dialing system, and without any notice or warning to its users, transmits generic telemarketing text messages to the users’ contacts from spoofed telephone numbers.”
According to Rattner, “spoofed” numbers are those in which the information transmitted to a call recipient’s caller ID display is falsified to disguise the caller’s identity.
Tribe App denies the allegations but agreed to settle the TCPA class action lawsuit to avoid the burden and expense of ongoing litigation. The Tribe App class action settlements were preliminarily approved on Dec. 4, 2017.
Class Members who wish to opt out of or object to the Tribe App class action settlement must do so no later than April 3, 2018.
Who’s Eligible
Class Members of the Tribe App settlement include anyone who received at least one text message sent by or on behalf of the defendant without a Tribe App user manually selecting the person’s name in the app, and the text message contained a link to download the Tribe App between April 10, 2013 and Dec 4, 2017.
Potential Award
Up to $500 per text message.
The Tribe App class action settlement will distribute funds on a pro rata basis to all qualified Class Members who submit a timely and valid Claim Form.
Proof of Purchase
Class Members must provide the cell phone number at which they received text messages from Tribe App that allegedly violated the TCPA.
