Inteleos Inc. f/k/a the American Registry for Diagnostic Medical Sonography Inc. (ARDMS) has agreed to pay more than $570,000 to settle a class action lawsuit accusing it of incorrectly scoring Registered Vascular Technology (RVT) exams.

If you took one or more RVT exams administered by ARDMS between Sept. 6, 2016 and March 14, 2017 and you were advised that you failed an exam when you actually passed at least one of the exams, you may be entitled to payment from the class action settlement.

According to the RVT exam class action lawsuit, a scoring error caused a number of people who took an RVT exam administered by ARDMS to be advised that they had failed at least one exam when they had actually passed the exam.

ARDMS allegedly immediately corrected the scoring error upon its discovery and advised affected test takers that it would reimburse them for their exam fees and related expenses.

The settlement documents note that 403 RVT exam takers may have received a “failing score” due to a process error, even though they had actually passed the exam. ARDMS reportedly mailed initial checks worth $250, $500 or $750 to affected exam takers (the amount of the check was based on the number of times the affected exam taker took the test). ARDMS also reimbursed a small number of individuals for the amount they paid for a practice exam and/or to verify their score(s).

ARDMS denies any wrongdoing but agreed to settle the RVT exam scoring error class action lawsuit to avoid the risk, uncertainty and cost of ongoing litigation.

The RVT exam scoring error class action settlement was preliminarily approved on Nov. 21, 2017.

Who’s Eligible

The court has certified two subclasses:

Subclass 1 includes anyone who took at least one RVT examination administered by ARDMS between Sept. 6, 2016 and March 14, 2017 and who were advised that they failed the exam when they had actually passed it, and who did not cash an exam reimbursement check sent by ARDMS and who did not request or receive compensation from ARDMS in connection with the scoring error.

Subclass 2 includes individuals who took at least one RVT examination administered by ARDMS between Sept. 6, 2016 and March 14, 2017 and were advised they had failed the exam when they had actually passed it, and who cashed an exam reimbursement check sent by ARDMS, and who did not request or receive additional compensation from ARDMS. Members of Subclass 2 do not need to submit a Claim Form to receive money from the ARDMS class action settlement. A check will be mailed to their last known address. If you moved after taking the RVT exam, contact the Settlement Administrator to change your address.

Potential Award

Class Members of Subclass 1 who submit a timely and valid Claim Form will receive a share of the settlement amount depending on their damages.

Each Class Member in Subclass 2 will receive an estimated payment of $300. However, this amount may be adjusted up or down depending on the total number of Class Members who remain in the subclass.

Proof of Purchase

Class Members in Subclass 1 must submit a Claim Form and any necessary documentation supporting their damages or harm suffered by the alleged RVT exam scoring error. To file a claim online, they must also provide the Claim ID and PIN Code that was provided on the mailed notice of the RVT exam scoring error settlement.
