Wenner Media LLC has agreed to pay $1.1 million to settle a class action lawsuit accusing it of violating Michigan law by disclosing the magazine subscribers’ information.
Michigan residents who subscribed to Rolling Stone, US Weekly or Men’s Journal in 2010 or 2011, may be entitled to benefits from the magazine subscription class action settlement.
Plaintiffs Kyle Sullivan and Jeanne Sloan, both of whom subscribed to Rolling Stone magazine, claim that Wenner violated Michigan’s Video Rental Privacy Act by disclosing the personal information of magazine subscribers.
“After consumers subscribe to Defendant’s publications, Defendant violates their privacy by selling its customers’ personal information, including, but not limited to, their name, address and subscription history, to anyone willing to buy that information,” the plaintiffs allege in the Rolling Stone subscription class action lawsuit.
The plaintiffs claim that Wenner’s data practices violate its customers’ privacy rights and expectations. They say they never consented to the disclosure or sale of their personal information. Further, they allege that they did not receive adequate notice from Wenner about the disclosure or sale of subscribers’ personal information.
Wenner denies any wrongdoing but agreed to settle the magazine subscription class action lawsuit to avoid the burden and expense of ongoing litigation. The magazine publisher will pay $1.1 million to resolve the litigation.
The Rolling Stone magazine subscription class action settlement was preliminarily approved on Dec. 19, 2017.
Class Members who would like to opt out of or object to the Wenner magazine subscription settlement must do so no later than March 5, 2018.
Who’s Eligible
Class Members of the Wenner magazine subscription settlement include anyone with a Michigan street address who received a subscription to Rolling Stone, US Weekly, or Men’s Journal and were subscribers between Jan. 1, 2010 and Dec. 31, 2011.
Potential Award
Varies, depending on whether the Class Member is an indirect subscriber (their magazine subscriptions were obtained from third-party subscription agents) or a direct subscriber of Rolling Stone, US Weekly or Men’s Journal.
Indirect subscribers who submit timely and valid claims are entitled to a free six-month subscription voucher for Rolling Stone magazine.
Direct subscribers may choose to receive one of the following benefits:
- A free one-year subscription voucher for Rolling Stone magazine or
- A cash payment of up to $10.
Proof of Purchase
Claimants are asked to provide the List ID from the postcard notice that was mailed.
