24-7-intouch

A $1.1 million class action settlement will benefit 24-7 Intouch job applicants who claimed the company violated the Fair Credit Reporting Act (FCRA).

If you applied for a job at Ascenda USA Inc. d/b/a 24-7 Intouch between Jan. 1, 2014 and Oct. 31, 2015, signed the Disclosure and Authority to Release Information Form, and your background check was obtained by 24-7 Intouch for employment purposes, you could get $60 from this class action settlement.

In addition, those who were fired or denied a job with Intouch based on the information contained in their background check report are considered subclass members of this settlement.

Plaintiffs Ashley Moody and Autumn Terrell filed the FCRA class action lawsuit in October 2015. According to the class action lawsuit, 24-7 Intouch violated federal law by the inclusion of two sentences of release language within in the D&A form.

Further, the plaintiffs claim “Ascenda’s process for distributing notice prior to taking an adverse employment action based upon a background check report” also violated the FCRA.

24-7 Intouch denies the allegations but agreed to pay $1.1 million to settle the claims and avoid the expense and time needed to pursue further litigation.

Class Members do not have to do anything to benefit from this settlement. If the settlement receives final approval, you will automatically receive a portion of the settlement fund.

Those who want to object to the settlement or be excluded from its terms must do so in writing by Feb. 1, 2018.

Who’s Eligible

Disclosure Form Class includes all Ascenda job applicants who between Jan. 1, 2014 and Oct. 31, 2015 signed the Disclosure and Authority to Release Information Form and whose consumer report was obtained by Ascenda for employment purposes.

Pre-Adverse Action Subclass includes individuals who were “terminated from or denied employment or promotion with Ascenda based in whole or in part on the results of their background check report.”

$60

Once attorneys’ fees and Class representative awards have been paid, the $1.1 million settlement fund will be divided equally with all Class Members who have not opted out. Settlement documents estimate the individual payout to be $60 “or possibly more if you did not receive or were fired from a job at Ascenda based on the information in your background check.”

Proof of Purchase

To benefit from this employee background check class action settlement, you don’t need to do anything but remain in the Class. To opt out or exclude yourself from the terms of the settlement, you must do so in writing no later than Feb. 1, 2018.

    how come they said i can still litgate? mines is for unpaid OT wages the courts said I have time causs it hasnt gone to court… and the check was the offer they send before it goes to court, to see if they even have to go to court.
