TM Transport, Cadence Premier Cargo Truck Driver Wages Settlement

If you worked for TM Transport, Cadence Premier Cargo, LT Cargo or Mato Equipment Leasing as a truck driver or truck driver trainee on or after Dec. 12, 2008, you could benefit from a $1.2 million class action settlement.

Truck drivers and trainees who were paid on a per-mile basis and whose employment was subject to an Independent Contractor Agreement may claim between $200 and $1,340 depending on the number of months worked during the class period.

The class action settlement resolves allegations that TM Transport Inc., Cadence Premier Cargo Inc. f/k/a LT Cargo Inc., Mato Equipment Leasing Inc., Laima Bubezlute and Tomas Maciulis violated the Illinois Wage Payment and Collection Act.

Class Members who submit a valid and timely claim will be paid set amounts based on the number of months worked as a truck driver or truck driver trainee with at least one of the defendant trucking companies.

The total settlement fund of $1,238,100 will be used to cover Class Counsel fees, award Class Representatives, cover the cost of the settlement administration, as well as provide payments to Class Members who file valid claims.

The truck driver class action settlement was preliminarily approved on Oct. 18, 2017. Class Members who want to object to the settlement or ask to be excluded from its terms must do so by Jan. 17, 2018.

Who’s Eligible

Class Members include truck drivers or truck driver trainees who worked for TM Transport Inc., Cadence Premier Cargo Inc. f/k/a LT Cargo Inc., or Mato Equipment Leasing on or after Dec. 12, 2008, who were paid on a per-mile basis under a Independent Contractor Agreement.

Potential Award

 $200 – $1,340 depending on the number of months worked.

• 0 and 3 Months – $200
• 3 and 6 Months – $400
• 6 and 9 Months – $575
• 9 and 12 Months – $775
• 12 and 15 Months – $1,000
• 15+ Months – $1,340

If Settlement Funds remain after all Class Members have been paid, a second round of payments may be mailed out.

Proof of Purchase

In addition to providing contact information, Class Members will need to indicate which company they worked/drove for, as well as the beginning and ending dates of employment.
