Persons who didn’t consent to receive Mandee text messages but got them anyway may qualify to receive either a $15 voucher or $10 cash from a class action settlement.
The Mandee class action settlement benefits persons who received advertising text messages on behalf of clothing retailer Mandee between Oct. 16, 2013 and Dec. 31, 2014.
Plaintiffs Frieda Zeidel and Carla Serrano claim they received unconsented advertising text messages on their mobile phones from defendant A&M (2015) LLC, the parent company of Mandee stores. Mandee is a retailer of women’s clothes and accessories.
According to the Mandee class action lawsuit, the defendant began a text message marketing campaign in June 2013, soon after acquiring Mandee from its previous owner. Zeidel and Serrano allege that as a part of that campaign, they and Class Members received text messages that they never consented to receive.
The plaintiffs claim these Mandee text messages were sent in violation of the Telephone Consumer Protection Act, a federal law originally passed in 1991 that now restricts the circumstances under which advertisers may send automatically-generated text messages. Under the TCPA, such messages may be sent only if the recipient has given the sender prior express written consent to send them.
The settlement allows Class Members to choose to receive either a merchandise voucher worth up to $15 or a cash award of $10. Class Members can claim their vouchers in person at a Mandee retail location. To receive a cash payment, Class Members must submit a Claim Form.
Mandee has also agreed to change its text messaging practices. It will send text message advertisements only to persons it has received prior express written consent from, and it will retain records of that consent for at least four years after it’s obtained.
Class Members who want to exclude themselves or object to the settlement must do so by Feb. 2, 2018.
Who’s Eligible
The settlement Class includes persons who at any time from Oct. 16, 2013 through Dec. 31, 2014 received a text message relating to Mandee stores that contained the language, “Welcome to VIP status!”
Potential Award
$15 voucher or $10 cash.
Qualifying Class Members can elect to receive a merchandise voucher worth up to $15 or a cash payment worth $10.
Merchandise vouchers will be available at Mandee stores. Once claimed, the voucher may be used anytime after March 1, 2018. The merchandise voucher must be used in a single purchase. Any voucher value not used in a single purchased will be deemed extinguished.
Proof of Purchase
To receive a voucher, Class Members must go to a Mandee store and present their name, residential address, and the telephone number at which they received the Mandee text message. This information must match the information contained in Mandee’s records.
To receive a cash payment, Class Members must submit a Claim Form with their contact information and the phone number at which they received a Mandee text message.
Claim Form
This claim form is for claiming a cash payment instead of a merchandise voucher. Merchandise vouchers must be claimed in person at a Mandee retail location.
NOTE: If you do not qualify for this settlement do NOT file a claim.

Claim Form Deadline
For cash payments, the deadline to submit a Claim Form is March 29, 2018.
The deadline to claim a merchandise voucher is May 30, 2018.

Has there been any update to the Mandee Stores text message settlement? No news as of today’s date (November 26, 2020).
