Consumers who received unwanted automated calls from Normandin’s Chrysler Jeep Dodge Ram and OneCommand Inc. can now receive either a $90 voucher or $40 cash from a class action settlement.
The class action lawsuit alleged that Normandin’s d/b/a Normandin’s Chrysler Jeep Dodge Ram and OneCommand Inc. violated the Telephone Consumer Protection Act by making automated calls using a prerecorded voice without getting the consent of the recipient.
Lead plaintiffs, Alan Brinker, Austin Rugg, and Ana Sanders alleged that Normandin’s, a car dealership in California, and OneCommand, an automotive marketing and advertising company, used telephone solicitation in violation of the TCPA. The companies, alleged the class action, used automated, prerecorded calls to contact consumers.
The messages, alleged the plaintiffs, told consumers that one of their vehicles required maintenance, however, the calls did not specify the vehicle or the service. Additionally, the message did not notify consumers about how they could opt out of the calls.
The defendants, Normandin’s and OneCommand, do not admit liability under the terms of the settlement, but have agreed to settle the claims. Under the terms of the Normandin’s and OneCommand class action settlement, Class Members who received automated telemarketing calls without providing permission may claim either a $90 voucher for services from Normandin’s or $40 cash.
Class Members can object to the settlement or exclude themselves from it by submitting a written request no later than Feb. 13, 2018.
Who’s Eligible
Class Members include “All persons who owned one or more of the 8,313 cellular telephone numbers to which calls were placed by OneCommand on Normandin’s behalf on or after October 16, 2013, through the alleged use of any automatic telephone dialing system or with an artificial or prerecorded voice, which calls allegedly were not made for emergency purposes or with the recipient’s prior express consent.”
Potential Award
$90 voucher or $40 cash.
Qualifying Class Members may choose to receive one of the following benefits:
- $90 certificate redeemable for the one-time purchase of goods and/or services at Normandin’s; or
- $40 cash.
Proof of Purchase
No proof of purchase necessary, but Class Members will be required to either submit a Claim Form with a Claim ID or PIN Code or provide the cell phone number that received the call.
