Saar’s Inc. has agreed to pay $475,000 to settle a class action lawsuit alleging it violated the Fair and Accurate Credit Transactions Act (FACTA) by printing the expiration date of customers’ payment cards on receipts.

If you used a personal credit or debit card for a credit transaction at any Saar’s or Super Saver Foods stores between July 20, 2014 and July 18, 2016, and your payment card’s expiration date was printed on the transaction receipt, you may be entitled to compensation from the Saar’s class action settlement.

Saar’s denies that it willfully violated FACTA but has agreed to settle the class action lawsuit to avoid the uncertainty and expense of a trial.

The Fair and Accurate Credit Transactions Act is a federal law that requires merchants to follow specific rules to help protect American consumers from credit card fraud or identity theft. FACTA prohibits merchants from including any portion of a credit or debit card’s expiration date on the transaction receipt and from including any numbers other than the last five digits of the payment card number on the receipt.

FACTA applies to all electronically printed customer receipts, including those printed at cash registers, self-service kiosks, and those provided to customers at restaurants.

Saar’s does not admit any liability but it has agreed to establish a $475,000 settlement fund to provide gift cards to Class Members who submit valid and timely Claim Forms.

The FACTA class action settlement was preliminarily approved on Nov. 2, 2017.

If you would like to opt out or object to the Saar’s Super Saver Foods FACTA settlement, you must do so no later than Jan. 12, 2018.

Who’s Eligible

Class Members of the FACTA settlement include anyone who used a personal credit or debit card for a credit transaction at any of the following Saar’s or Super Saver Foods stores between July 20, 2014 and July 18, 2016, and were provided a printed receipt that included the payment card’s expiration date:

  • Super Saver Foods in Auburn, Wash.
  • Saar’s in Oak Harbor, Wash.
  • Saar’s Super Saver Food in Renton, Wash.
  • Super Saver Foods in Seattle, Wash.
  • Saar’s in Tacoma, Wash.
  • Super Saver Foods in Tukwila, Wash.

NOTE: A list of the affected stores and their physical addresses is available on the Claim Form.

Potential Award

A Saar’s gift card valued at up to $75.

Class Members may make only one claim even if they have made more than one eligible credit transaction during the Class Period.

The actual value of the gift card may be reduced on a pro rata basis, depending on the total number of eligible Class Members who file timely and valid claims.

Proof of Purchase

Class Members must provide proof of purchase, such as a copy of the receipt that contains the expiration date or a copy of a credit card statement showing that they made a purchase at a Saar’s or Super Saver Foods store during the Class Period.
