Mammoth Mountain Ski Area LLC has agreed to pay $3.75 million to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act by making prerecorded calls or calls using an artificial voice to consumers without their prior express consent.

If you received at least one prerecorded or artificial voice call from Mammoth Mountain between Jan. 1, 2013 and Dec. 31, 2014, you may be entitled to claim up to $500 from the TCPA class action settlement.

Plaintiff Paul Story filed the Mammoth Mountain TCPA class action lawsuit on Sept. 21, 2017. He alleges he received calls on his cell phone from Mammoth Mountain encouraging him to purchase season passes even though he had never provided his express consent to receive telemarketing or advertising calls from the ski resort.

Story alleges these calls violate the TCPA, which prohibits automated calls or messages to consumers’ cell phones without their express consent.

Mammoth Mountain denies the allegations but agreed to settle the TCPA class action lawsuit to avoid the burden and expense of ongoing litigation. The ski resort has agreed to pay each Class Member who files a timely and valid claim up to $500, which is the statutory per-violation penalty allowed under the terms of the TCPA. Willful violations of the TCPA may result in statutory penalties of $1,500 per violation.

The Mammoth Mountain class action settlement was preliminarily approved on Nov. 7, 2017.

If you would like to opt out of or object to the Mammoth Mountain TCPA class action settlement, you must do so no later than Feb. 20, 2018.

Who’s Eligible

Class Members of the Mammoth Mountain TCPA settlement include anyone who, between Jan. 1, 2013 and Dec. 31, 2014, received at least one prerecorded or artificial voice marketing call on their cell phone or landline telephone from or on behalf of Mammoth Mountain.

Potential Award

Up to $500.

The actual amount each qualified claimant will receive depends on the total number of Class Members who submit valid and timely Claim Forms. If every eligible Class Member files a claim, each claimant would receive an estimated payment of about $75.20.

Proof of Purchase

Claimants must provide the phone number at which they received calls from Mammoth Mountain from Jan. 1, 2013 to Dec. 31, 2014.
