TCPA junk fax spam

A settlement has been reached in a class action lawsuit alleging Bisco Inc. sent fax advertisements without an opt-out notice that is required by the Telephone Consumer Protection Act (TCPA).

If you received a fax from Bisco Inc. or Bisco Dental Products Co. between Dec. 8, 2011 and Dec. 8, 2015, you may be entitled to benefits from a $262,500 TCPA class action settlement.

Plaintiff Fulton Dental LLC filed the TCPA class action lawsuit against Bisco after it allegedly received a fax advertisement from Bisco that promoted goods or services for sale.

According to the Bisco class action lawsuit, the faxed advertisements did not contain an opt-out notice as required by the Telephone Consumer Protection Act. Further, Fulton asserts that it never provided consent to receive faxes from Bisco.

“By sending Junk Faxes to the class, Bisco violated class members’ privacy rights,” Fulton alleges in the TCPA class action lawsuit. “Plaintiff and the putative class members have had their privacy improperly invaded, as the transmissions jammed their facsimile lines from other legitimate business communications.”

Under the TCPA, consumers who receive faxes that do not comply with the law’s requirements may file a claim for $500 to $1,500 per violation.

Bisco denies the allegations but agreed to settle the TCPA class action lawsuit to avoid the costs and uncertainties of ongoing litigation.

Under the terms of the TCPA class action settlement, Bisco will pay $262,500 to create a settlement fund. Approximately 25,127 Class Members are eligible for benefits from this fax spam settlement.

The Bisco fax spam class action settlement was preliminarily approved on Nov. 9, 2017.

Class Members who would like to opt out of or object to the Bisco fax spam settlement must do so no later than Jan. 30, 2018.

Who’s Eligible

Class Members of the fax spam settlement include: “All persons or entities within the United States to whom Bisco Inc. or Bisco Dental Products Co. sent a facsimile from December 8, 2011 through December 8, 2015, and who are identified by their fax numbers in Bisco’s fax log Bates numbered B00020-1307.”

Potential Award

To be determined. The amount of compensation each claimant will receive depends on the total number of Class Members who file timely and valid claims. Qualified claimants will receive a pro rata share of the available settlement funds.

Proof of Purchase

When filing a claim, Class Members must provide the fax number at which they received the faxed advertisements from Bisco.
